    Tax questoin before filing

    Ok. Weird situation here. I still haven't filed my 2004 taxes because I have yet to receive any information telling me what I've paid. I never got a W-2 from my job (they change offices way too much and its real hard to get a hold of.. kinda a weird situation like I said)

    So anyways I've called the IRS. While they do show me working some, they don't have all my stuff reported .. It shows that I only made 2000 something dollars, which I am a college student, but I made more in the 20,000 dollar range because iwas doing full time work as well.

    So what do they ask to see when you file? I mean the IRS shows that they reported only 2000 bucks. (I worked in 2 states, and they only have info from one store. I worked 3 stores.) I don't know what to do really lol.. I mean when I file I don't know what I will say because obviously I need to file before (im assuming).

    Like I said weird situation, and I still haven't received answers on my taxes for that year so I figured I would ask what they will ask me for.

      your 2004 taxes are late. you were supposed to file last year. you are going to get penalties and fines and interest assesed if you owe any money at all. i hope you dont.

      if you do owe and for some reason they think you only made $2K and you didnt tell them thats not true (because they type in what you say when you call lol) then call them again and tell them to file for you instead. see what their return looks like. if it only reports $2K then so be it. accept it and move on.

      with taxes the faster you file the better. period. thats always the answer. if you wait until after 3 years and they owe you money, you cant claim it anymore.

      as for taxes and bk, yes you have to complete those taxes before you file or your case will/might get dismissed per new laws. if you need to inlcude the other job then just contact them and ask them to send it again. if that doesnt work fast enough for you then use your final checkstub and let irs know you didnt recieve one and contacted them and they couldnt get it for you in time.

        I'm pretty sure I don't owe anything. My mom does my taxes so usually I end up not paying because I pay more out ahead of time. I can't get ahold of the office i used to work for. They are a very shady company, and I know because I used to manage the restaurants lol. I called the IRS and they sent me papers of my 'W2s" that were reported.

        The reason I'm worried about it showing only 2k as income.. won't the trustee ask me "Why I said I was making X amount of money on certain credit card apps, and car loan applications"

        I don't want it to look like I was trying to defraud anyone, so that was my main concern.

          answer: no he wont. he doesnt see your apps. you just fill in the petition and thats all he sees along with financial statments you give him.

          nothing to worry about there. but if you made 20K+ then you are going to have to write that in. you can not lie.

            Alright, that was just my main worry lol. Other than that I'm sure that I don't owe anything, if so it wasnt much at all.

              well, thats the trustee. if the creditors want to onject due to fraud then thats their issue. they can but dont usually do that based on your credit app info.

                Is it actually 2004?? or did you mean 2005??

                If it's 2004, you are really gonna have a problem. You'll need to get that filed and taken care of before you can file BK.

                Attnys here require 4 years of taxes be filed with the petition for BK. I don't know if that's part of the law or if attnys are doing CYA. If we don't have them, the attnys can arrange to get a tax transcript for us. I think the new law requires filers to have paid their taxes for 3 years prior to filing BK. No discharging newer taxes owed now. Just old taxes from years ago.

                  If your previous tax years were filed in a timely fashion, you can get the IRS to drop the late filing penalties...how do I know...because I worked a deal with them & they explained that to me. They took the fine off for 2001 for me because my 2000 and previous returns were kosher...so keep that in mind...sounds like you need to supeana your records or check your bank deposits on your paydays?

                  But you do need to deal with that before you file bk...that's a given.

                    Any company you work for has to file form W-3 and copy A of your form W-2 with the IRS. The IRS also requires filers to submit a copy of their W-2 when filing their taxes - I assume it's more for a cross check than anything. The IRS already has your info though so if they are telling you they only show $2,000, then use that. There is an IRS form you can use to formally request that info. I don't remember the form number right off the top of my head.

                    The important thing is to get something filed because you need it for your bk. Your return can always be amended later with form 1040X. Oh yeah and once you do file, the IRS will find that other $18,000. It will take them a couple years but they don't miss W-2 errors. What they do is process the return as filed but they red tag it if there is something suspicious and then it waits in line for a review. The process takes a couple years. Then the IRS starts sending you love letters.

                      Oh yeah since you say you made $20,000 and they say it's $2,000, I would suspect the person you was talking to was dropping a zero off the figure.

                          Well I made more than 20k I'm pretty sure really. Just was giving a scenario. I don't see why they wouldn't report me working in a differenet state, because from what I know about taxes you have to file with that state as well. I worked in GA/AL at the time and it's only showing that I worked in AL. Maybe it got into 2005's I don't know I haven't received any W2's yet. Which doesnt surprise me, we received them after the deadline last year. Of course if you complain to the IRS they don't do anything. POS Company.

                            Oddly I have been audited personally two times already and am expecting another one soon. Every time has to do with my ex. First time, she worked 4 or 5 jobs in a year - I missed a w-2. Second time she hid a job from me so we got nicked again. Happily divorced after that but it doesn't end. I'm coming up on a third time because she has been claiming the kids as dependents the last three years although I am the only one who can. Both claiming the same dependents puts up a red flag - it's only a matter of time before the love letters begin again.
