    Possible new job and BK

    I have an offer that will increase my income. However, I am "in between" now and would like to file THIS WEEK.

    Anyone with experience like this? The new job may make a 13 the road that the atty will advise, but I've been self-employed so long- whats the guarantee that this job will stick, and what if I jepardize these crucial first weeks with a BK?

    One atty advised that I turn down the offer- that means I'll need to live on air and water- until that gets turned off, and for how long?
    Any thoughts?

      The general consensus of advice to others looking at a new job or extra odd job for more money is to wait. At least until after the 341 meeting. After discharge is even better.

      Can you tell the employer you won't be available, for whatever reason, for a month or so??!!

          That will queer the deal and I'll be scrapping until another offer comes along. Jobs are not as frequent in this economy as the ruling party would like to tell us! (had to throw in my 2 cents there) I've been looking for 3 mos.

            Ohhhh....well then it would really depend on how much you want this job. It could really mess things up depending on what the income is. My dh took a new job but he didn't start until the day we were discharged. (Coincidence-our goal was after the 60 days)

              Good for you! Sometimes everything works out!

              I really do not want to stop the new job opportunty. If it means I file a 13 then I can suck it up, but hopefully I can find a smart atty.

              More questions:

              1-If I default on the 13 (I'm being realistic- 5 ys is a LONG time and my income is sketchy) can I convert to a 7 or will I need to wait the 6 years to refile-my WORST nightmare is that this will NEVER END!

              2-Does the IRS ever negotiate in a 13 or are the amounts all due in full? These amounts are well over 3 yrs old- and inflated with penalties!

              3-Does anyone in this position ever get good sound sleep? I need to take my herbal sleep remedy in double doses AND a drink before bed now and I STILL wake up in the middle of the night!

              4-Any atty referals on this board?

              OK- not really a question, but one none the less- I just wonder how many people just gave up and killed themselves because this seems so hopeless? Not there yet- but unless there is hope...

                If you take the job, whether you start tomorrow or in 3 months, it should impact your BK because it is something that has already started. If you filed last month and received the job offer now, different story.

                Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

                  Ch. 13's can be adjusted (if income or expenses change significantly) and if things are drastic enough, it can be converted to a 7.

                  I can't help with the other questions, though I'd think its quite normal that you are taking this process very seriously. You're researching, asking questions, etc. and that will only benefit you in the end.

                    the atty should know your situation better then we do. i would follow his advice and also see a few more. they are free and you get a fast course on bk imo. you dont want to risk paying money back for 3 to 5 years if you dont have to.

                      We chatted about me getting a job during a Consult yesterday.

                      I have only worked on and off again, part-time at times, for years since kids came along. I haven't been employed at all here.

                      Attny asked if I was looking for a job. I said I had considered getting a job, and had even looked for one, until we realized we were too far financially gone. I wanted to wait until after the BK was decided to see what to do. Attny said good idea.

                      If we get a 7, getting a job after is great. If we get a 13, it makes no sense. Except for an adjustment for job related expenses, everything I would make would go toward a Ch 13 plan.
