    demand for turn over??

    got a question??
    got my discharge notice the other day, but also recieved a demand of turn over of refund {irs}.my letter states that if not more than $1000.00 they will abandon their demad of turn over, just recieved my refunds fed-state total of bout $900.00 but have not sent them in because it was less than the demanded $1000.00 or more. what do you think my ods are of them taking it any way? and shoul i the refund to them anyways so that there is no reasnon to revoke my discharge?? this letter is confusing and sounds like they are trying to leave a door open to screw us!!

    I'd follow instructions. Did the letter state you were to turnover the refunds regardless of the amount and the truste will return them if they're abandoned?

      By not filing them/sending in a copy of the return, you risk not having your case closed. Do as the letter said. The sooner you do, the sooner your case moves to completion.

        the letter from the trustee states to turn over the refund and the fye tax papers. but then goes on to say that if not more than $1000.00 they will not seek their turn over, but in order to verify the refund amount to send copy of my filed fye fed/state tax refunds. i sent them my copies so should i send in my checks too??

          If it says they only want the refund if over $1,000 and yours is $900, then just send the returns. If it says to send everything, but they'll return it all if under $1,000, send all.

          You would rather have the tax $$ sooner than later, but it would be best to move your case forward rather than delay everything.

            ok its been a month since i got our discharge papers. i need to cash my tax returns...soooo baddd!!! still waiting for a comfirmation from trustee so now i have phoned my attourney several times wondering why we have not recieved any kind of compliance from the trustee. they say they will email her today to find out what is going on..........well i got a call today from my attourney saying the returns were ours ...how come it took a call from our attourney to find out something so simple as that, why dont the trustees send us a letter to tell us we could spend them? like she said she would!!
