    A real quick question about my chapter 7...

    My case seems to be moving along nicely so far but I have a question that I forgot to ask my attorney and figured someone here could answer... Is my filing of bankruptcy going to appear in my local newspaper? I'd really rather not have my name and financial situation splattered all over for everyone to see if it can be avoided by some type of legal procedure. Anybody know more about this? (I'm in Florida BTW... duh) ;)

    It could. All documents submitted to the BK court are Public, 11 U.S.C. Section 107. (note, documents only submitted to the Trustee, i.e. Tax Returns, Paystubs, etc are not public).

    So if your newspaper wanted to, they could publish the fact that you filed bankruptcy.

      That's not exactly what I meant. I was referring to the laws surrounding the filing of a bankruptcy. Is it a necessity that the filing appear as some sort of public notice or anything like that?

        Bankruptcy is public record. In other words, anyone could find out that you filed bankruptcy, by going to the appropriate source.

          From what I gathered from the original post, Chris wants to know if the paper announces BK filings like they announce births, or arrests. This is something I would like to know too.

            Your best bet is to check out the legals section of the newspaper that you are wondering about. If they routinely post bankruptcies than yours will probably be in there. Like Todd and HHM said, bk is a public record so the newspaper has every right to post it. They don't single certain people out usually, just post the entire release of all bk's in the state from what I've seen.
