"Lost my home" in the unperfected title case. Yes, they will put a little old lady out on the street - believe me!!
Am fighting though...
My lawyer has kept my case "out of court", letting everything slide by, hoping to get it all over with and settled.
Final judgement taking my home was Oct 27th. Court also took Banks interest in it on Dec. 2nd
Am presently in negotiations trying to buy my home/land back, was fortunate to have a "friend" who is willing/able to back me financially.
Have consulted other attorneys (without my lawyers knowledge), and YES, I do have a valid "lender negligence" case against all parties involved, and possibly one against my lawyer also. (he's been trying to save his own butt, thru all of this.) I had to go to the courthouse records myself to get info on what has happened in court. My lawyer has told me "nothing" - just brushes me off and says he's waiting on Trustee. Keeps telling me to "find an apartment".
So we are negotiating now with Trustee regarding a reasonable "buyback", and AFTER everything is settled, there will be suits to follow.
I had paid for title insurance at closing to protect my interest - something else my lawyer "failed" to notice.
So.....for now, am still in my home (how long I don't know), but maybe good Lord willing, and negotiating goes well, I may be able to save my home.
Sure has been a nerve-wrecking ride, but my present (silent) attornys say it will all turn out VERY WELL IN THE LONG RUN.
Best part of about my "silent attorney's", they have been friends of mine for 20 years (worked for them). They just don't handle most bankruptcy cases. Was upset because I didn't go to them - was really too embarrassed.
So now = its the waiting game again and time will tell.
