    Yes, do keep us posted as to the decision that you make regarding this.....
    Also contacting another attorney was a very good game plan, this one seems to understand the situation.....

    My home was seized and sold because I could not convert to a Chapter 13 (payments too high) in trying to keep it..... along with other factors involved.

    Yes you will find life will be better and you won't struggle so hard to make ends meet....

      This is true. However, my attorney said it would take about 3 years to be able to buy another house. However, in my opinion, I do not even want to own a house right now. I am terrified of falling values. Who even knows what a house is worth today? Wages are lower, housing is higher, there is such a large gap. I wonder how that gap can be maintained. Our current president talks about how home ownership is such a wonderful thing. That may be true for some. In my case, it has caused undue financial hardship, which lead to BK.

        SinkingFast - I appreciate this. My "real" attorney has not told me more than "just leave the house and walk away from it." Literally. I was not sure if that meant foreclosure or what. But I am more than capable of talking to the mortgage company myself and asking about that. And I will! Thanks for getting that info for me.

        Now I am just trying to prepare for my Friday house visit and hoping for the best. I have decided that I will be honest, if asked, about the 13, but will *not* tell them I am planning on converting a 7 in future. Seems like it would look better to say "I am letting house go back because I would like my 13 debt load to be more manageable."

        Thanks everyone - this BK stuff is really a stressor, ain't it???

          I would do myself a "favor" and not mention the word BK unless its brought up by the other party.............
          Your only renting from them, sooooooo the least they know the better.....
          If asked just tell them your in a Chapter 13 and have decided to let the house go back so you can manage the other bills better.....

            We just went thru looking for a new place to live. We decided it would be best to head the Credit Check issue off at the pass, so to speak.

            We told prospective Landlords that we had a house for sale outa state, on the market for nearly a year, and we can't sell it. We were presently moving to Foreclosure. So if they did a Credit Check our Credit was gonna look terrible. We didn't tell everything else.

            Amazing how a statement like that works in weeding out prospective Landlords. Most didn't care. Not a problem. Do we currently pay our rent on time? That was their only concern.

            The others, we just steered clear of. Good thing too. I saw one of the Credit apps. You'd a thought we were buying the house instead of just renting.

            So maybe skirt the truth a bit. Let them know you're house is headed for Foreclosure because the payments and repairs were just too much. If I remember correctly, you originally worked with a Credit Counseling company that did not apply your payments correctly. You might mention that as well.

            Say what ever sounds logical and feels comfortable for you. I ran over several different things in my mind before I hit on one that sounded good. Then I practiced saying it out loud a few times to see how it came across and what needed work. Without too much work on your "line" it won't come across as rehearsed. It will sound genuine and honest. Which it is. You just aren't telling them your entire life's story.

            You'll find someone who'll look beyond the Credit and see that you'll be a good tenant.

            If you find out that Short Sale won't work for you, check out the Foreclosure process in your state. Then you'll know how long you can stay in the house, rent free, and save before you absolutely have to move.
