    living on social security

    I have just had a car repossed and I owe much more than the car is worth.
    I have been behind in my house payments but have worked out an agreement with the mort. co. to catch these up by sending extra with my usual payments for four months.
    I have fallen behind in many bills and have a organization that I send payments to every month to settle these debts.I would like to include all of these when I file (all of these debts were over $500.00 each.) I have several that is under $500.00 that that I am trying to pay, but they are very much behind.
    The credit union who repoed my car says that after they sell it they are going to file a legal judgement for the balance.
    Now for the main question. I am going to make an appointment with a lawyer next week to file bankrupcy. My husband doesn't want to file. However all of these will be my debts and his name isn't on any of them. I don't want to include the house in the bankrupcy. and the only income we have is we both get social security which is automaticly deposited.
    Can they take over this checking account since this is all the income we have? I don't want to lose my house as I don't know where we would live then. There is about $58,000.00 still owed on the house and we probley dont even have half of that in equity. We have no savings or extra money of any kind.
    What will be done concerning the judgement? any help would be appreciated.

    Hi,

    Your SS will be fine. You're going to want to get current on your mortgage so you can have the debt reaffirmed under a chapter 7 bankruptcy in order to keep the property.

    Definately bring up these matters with your attorney during your free consultation, to see what he/she recommends you do, based on your personal situation. Just tell the attorney what kind of results you're expecting from filing bankruptcy. Also, all judgements can be discharged under Chp 7.
