    It's not all easy living post bankruptcy

    I thought I'd share my personal experience to let people know that bankruptcy does affect your life. I know this site is for information and encouragement, but sometimes I feel like the attitude here is misleading in that it makes some people think life during and after bankruptcy is smooth sailing.
    I filed in Oct, what I thought was a very simple no asset case. I own no property and I don't even own a car. The trustee on my case filed a motion to extend on everyone until Aug06, for taxes. From what I'm reading it seems like that was kind of unneccesary and he could have let the case discharge but held off closing until he got his hands on my return (which is $11 btw).
    Well, right now my lease is up on my very expensive apt so I thought I'd try to move to a different apt, start saving money or at least make smarter money choices post bankruptcy. I cannot find an apt that will let me apply. It's humiliating and very discouraging. I will admit I even omitted my bankruptcy on one application just hoping it wouldn't show, but I was dinged on that. I could stay at my current apt but it's about $300 over what I should be spending on housing. I'm so stressed and frustrated. I spent one hour dialing every apt complex in town and being upfront and asking about my qualifications and getting some varied responses. Some were sympathetic but some were very haughty and rude when I told them I had filed. I found one place that might consider me but honestly it's a dump. It's shabby and very outdated and not exactly in the best neighborhood, but I kind of feel like that's what I deserve for not being financially wise to the point I had to declare bankruptcy.

    anyways. wish me luck because if this apt doesn't accept me I don't know where I'll be living in the next months.

    oh, also there is a question in this post too. Does anyone know if your bankruptcy is not discharged and your expenses change significantly, can the Trustee file to dismiss? I'm talking a few hundred less for housing, which I was hoping to start a savings account with since I never had a rainy day fund for the inevitable expensive medical or emergency issues that arise, not to mention no such luxury of starting a retirement savings.

    You did the smart thing to check first rather than pay a fee to apply and then be turned down.

    We got lucky and found a small, private corporation that owns several rental units. A pair of guys own a Construction Company. Those guys and one of the guys' wife, who's a Realtor, own the Rental Company. They have Condos, duplexes, and homes that they rent.

    The Realtor showed us the Townhome Condo, gave us a copy of the Lease, and told us to give her a call as she handed me her business card.

    We really liked the unit. So I called her back about it and told her a bit about our financial situation. I did tell about having a house outa state that is in Foreclosure due to not selling, but I didn't say we are preparing to file BK. She said not a problem. They don't pull Credit anyway.

    She asked for proof that we pay our current rent. We're on the outs with our Landlord, and the Landlord just changed how we make our payments. So I told the Realtor we had been paying the Landlord directly but she just changed us over to a Property Management company. That I didn't know if they had our previous payment records. Then the Realtor said she'd take a letter of employment instead.

    Hopefully, you can find some smaller Rental Company like the one we found. One that's more interested in the people they rent to than what it says on paper about you.

    Another thing that may help you is a letter of reference from your current apt complex. See if someone in the office will write one up for you showing you're current on all payments and have paid as agreed for however long you've lived there.

      So your case has not been dismissed. Sounds like it will not be until at least Aug 06. I wonder if that is why you are having trouble renting an apt. I hope others chime in here, but it sounds to me like that is the reason that they do not want to rent to you. Our local newspaper talked about how one could even buy a house after 2 years out of bk. God knows, I would not recommend that with our current economy. I guess I am thinking that the landlord is concerned that you will include your lease in your bk and they will be sol. What state are you in btw? I am terrified of my 341 meeting. I also am due back a tax refund that they will probably want (and I really need the money). Can you give us anymore details?
