    Help

    I filed bnkrptcy in April 2004, I didn't file my car. It blew up. I called the credit co. they told me to stop my electronic pymnt, to use a pymnt or 2. I used the money to get a cheap auto. When I called the co. back to re-start my pymnts in March, they are demanding a reinstatement fee & late charges that equal a months pymnt. They won't negotiate anything & now I am trying to come up with a pymnt for FEB. I asked them for help & not charge late fees since I can't go back to the electronic pymnt & they told me they don't make negotiations. I've paid by electronic pymnt for 43 pymnts. I have 17 pymnts left. I asked them to make adjustments to my pay schedule & they won't make any adjustments.
    Would it be easier to just let them send this to a collections agency & work out a negotion with them? I can't meet the credit co.'s demands anymore, but I want to pay off the final 17 pymnts without all these charges. I'm sure the late fees will probably get interest applied too.

    I would tell them quite bluntly that it would not be in their best interest to pay a repo man to come after the car, since it apparently is not even drivable anymore. Then they might be more likely to consider dealing with you on the issue. Any chance of you getting a tax refund soon? If so, perhaps you could use it to offer them a settlement of less than the amount owed on the account. If you could offer them, say, 60% of the remainder owed, then maybe they would be glad to accept it and be done with you since the collateral is not worth anything. Just a thought. Depending on how much is owed, they'll probably just harass you a while and then eventually write it off and send it to collections.
