Will the fact that I only work part time, although I could probably make more money working full time at fewer $ per hour prevent me from being able to file bk? I shouldn't work full time for health reasons.

How about working two jobs part time, then it won't affect your health.

I'm a nurse and can think of a fair number of illnesses that fit this picture - multiple scelerosis, congestive heart failure, fibromyalgia, and kidney disease to name a few. helpme...I was working full time prior to my husband and I filing for BK but my hours were cut, etc...so I was working part time when we filed. My attorney said it might be an issue because of an expense we were claiming(private school tuition - long story - another time) but the trustee didnt even bring it up...I cant imagine it will be a problem and just for the record you dont owe anyone an explanation why you are working part time instead of full time.....we are here to help you get through your BK...

The only time this would raise a flag is when a debtor chooses under employment on purpose just to get in under the means test. If you quit a good paying job just to file the courts don't like that unless you have an explanation. In your case with health issues and no recent history of full time employment it shouldn't be a problem.

I do not work outside the home at all and it was not an issue. I stay at home with our children. Our kids had to go to our 341 hearing so the trustee saw how young they were. He was pleased I was staying home with them.
Remember, most trustees are normal caring people. If you have a medical reason I'm sure you'll be just fine!Filed 09/05

I said MOST, not all. Minny's would fall into the "not-most" catagory. I'm sure Minny would still admit that she just got one of the bad ones and most are nice people for the most part.Filed 09/05
