    Scared No More

    Well.. back in early May, I joined this forum because I was actually thinking about BK. My, my my, things have changed!
    The only reason that I was considering it, because I was in the process of being sued by a debt collection lawyer. I searched for hours on this board and another credit related board and decided that I am going to fight these scumbags.
    I filed my notice of intention to defend, answer and defenses;
    filed a motion to strike;
    submitted an opposition;
    and on June 08th, the court/judge dismissed the case with prejudice.
    I guess the scumbags rely on default judgements and they realized I was going to be difficult

    Now, that as of this month, all of any alleged debts that I may owe are past the expiration of the SOL time frame. I can breathe a slight sigh of relief, but I can't relax too much. The journey is far from over.
    BK is of last resort to me; I have too much at stake to risk filing for a 7 or 13 (security clearance; pending re-investigation). Plus, I know for a fact I would have been stuck in a 13 plan, and my life would be hell for the next five years, scraping from the penny jar, in addition to twins that are due in January.

    Just wanted to give the forum an update and the good news!

      It's fantastic to learn when someone can go up against them and come out "smelling like a rose"...........

      Good for you for not standing still and taking it....... fighting for your rights, and not giving in under the pressure.......

      Yes, if we "fight" we often will win in the long run.......

        Way to go, JosephLB! Where debt collectors are concerned, it does pay to be proactive for yourself and fight for your rights. Glad to hear the outcome was so positive for you and thanks for letting us know your good news!

        08/10/11 - DISCHARGED !
