    Debt

    Can anyone tell me who owns a debt?

    I had a loan from my Mother, who is now deceased. The loan was obtained by her thru a credit card, the credit card company filed a claim with probate, but didn't file their fees. Went to formal probate & judge ruled untimely, therefore wiping out the estates debt. I had a verbal agreement with my Mother for payments, time period of loan & interest, nothing in writing.

    Now the personal representative (executor) & his attorney are trying to collect the debt from me. They are not giving me credit for any amount that I paid to my Mother over four years.

    If the estate debt is wiped out by the judge, is mine to the estate. It's almost paid, even though the personal representative & attorney don't seem to agree.

    Help!!!
