I filed for bankruptcy in 1997. It was also discharged. I was looking at new cars last weekend and the sales person told me to call Equifax and get the bankruptcy removed from my credit report and I would get a better interest rate. I called Equifax and the rep. told me I had another year before it could be removed. I asked her if there wasn't some way to remove it now. She said yes. She told me to call the "courthouse" and request a Letter of Deletion be sent to them. I asked her if she had the phone number to the courthouse and she said yes and gave it to me. My question is.....has anyone ever done this before? I don't want to make a fool out of myself by calling a government facility and asking this question. I guess it's worth a try though! Please let me know your thoughts. Thanks!

The bk law (old and new) states very clearly that both discharged (successfully finished) and dismissed (unsuccessful and thrown out by the court) Ch 7 bankruptcies and also dismissed (unsuccessful) Ch 13 bankruptcies each stay on your credit record for 10 years from the date of filing. Successfully completed and discharged Ch 13 bankruptcy stays on your credit record for 7 years from the date of filing.
I personally have never heard of being able to remove a bankruptcy from your credit record a year early just by calling the courthouse to get a letter for the credit agencies, and I've done many, many hours of research on bankruptcy and credit repair. Sounds too good to be true - which means it probably isn't true.
However, never say never....perhaps one of our other members knows something about this?I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
