    car repo

    just want to no how long it would take for the bank to repo my auto. I am 2 months behind and owe 13,000. My lawer told me that I could file chapter 7 180 days from my last credit card transaction back in june,25,000 in credit card debt. Will I have enough time to keep the bank for the auto loan from suing me untill I file ?

    I would think they'd be looking to repo it within the next month or two, if you don't pay anything on it. If you file in january, they probably wouldn't sue you by then, but you will lose the car long before then if you don't pay on it.

      Well, you could lose it next month........90 days late. If I understood that your last CC transaction was in June, then 180 days is Dec.........but.........how much was the last transaction and what was it for? I don't see the 180 days being cause for a BK being dismissed, but you would be responsible for any/all charges within the 180 days of filing......so.....if it's not thousands of $$, then filing sooner shouldn't be an issue.

      On a side note, if you filed before the bank repo's the car, you could get to drive it for a while longer. It could take some time for the bank to get the Automatic Stay lifted, granted and make arrangements to get it. 2 or 3 months maybe once you've filed

        the credit card transactions was balance tranfers 10,000 on two cards to pay off other high interest cards.
