    With virtually no public debate, the Senate Judiciary Committee (news - web sites) easily passed the "Bankruptcy Abuse Prevention and Consumer Protection Act" a few weeks ago. Three Democrats--Joe Biden, Dianne Feinstein and Herb Kohl--assisted Republicans in shuttling through the anti-consumer, pro-debt giveaway to the credit card lobby.



    Under the guise of reform, the bankruptcy bill makes it harder for poor people, women, the elderly and service members to pay off their debts. (See Katrina vanden Heuvel's recent dissection of the bill's numerous flaws.) To solidify the bill's success, big credit gave $101 million to political candidates and party committees over the last six years, the most of any lobby. Republicans accepted 64 percent; Democrats 36 percent.


    Despite their financial indebtedness, Democrats have managed to block the bankruptcy bill twice before in the past seven years, through a Bill Clinton (news - web sites) pocket veto in 2000 and an amendment by Charles Schumer in 2002. The Schumer amendment corrected an absurd loophole that allowed anti-abortion activists to avoid paying court fees incurred while illegally blocking abortion clinics by filing for bankruptcy.


    Now the bankruptcy bill is back on the Senate floor, with debate ongoing this week and possibly next. Opposition Democrats plan to offer a slew of amendments, including Schumer's"poison pill"--as dubbed by social conservatives--aimed at either killing the bill or making it more equitable.


    Yesterday Republicans defeated an effort by Senate Minority Whip Dick Durbin to exempt all members of the military from a new "means test" by card companies that would measure income and assets to determine whether owners must repay their debts or have them canceled in bankruptcy, a decision previously relegated to the courts. Durbin's amendment would have also protected the assets of soldiers called for duty in Iraq (news - web sites) and Afghanistan (news - web sites). The Senate instead passed a proposal by conservative Republican Jeff Sessions that would accomodate only active-duty service members, low-income veterans and those with serious medical conditions.


    Still, Democrats may fight in other ways. The bill's leading opponent, Ted Kennedy, wants to give courts more authority to limit the amount of money corporate executives could receive in bonuses and severance pay if their company files for bankruptcy. Kennedy will also introduce amendments expanding safeguards for the two million Americans who filed for bankruptcy due to illness or rising healthcare costs, protect employees of bankrupt companies, and shield low-income Americans from the costly means test. An amendment to raise the mininum wage could also be a possibility.


    If necessary, Schumer has vowed to filibuster the bill. Based on the previous judiciary vote, however, Republicans will likely have the Democratic support needed to override any filibuster attempt. The bill's sponsor, Chuck Grassley, predicts an 80-20 final tally. As the Senate begins debate, click here to tell your Democratic Senator to stop this bill's drastic affront to consumer rights.

    Thank you for the info. Can you please provide some links for us? If I can grab the time later I'll try to find afew. As a Republican I am disgusted with the whole mess. My party and I do NOT always agree. Not just because I have filed in the past. I am concerned for the impact on families.

    It is my understanding that some rotten BASTARD (that is the only way to describe the person) has even inserted language that would consider a Child's income as part of your ability to repay. Hilary Clinton vehemently opposed this bill as First Lady. Senator Clinton now backs this bill, disgusting.

    Families are hard pressed as it is. Will we see the days of King David, when "men who were indebted rallied to him"? If people are pressed beyond a certain point they will rebel. this Bill is awful for families. NO punishment is meted out to companies who front Credit when they know you are desperate. This is where hatred toward the Federal Government starts to seethe in otherwise peaceful people, this is an attack on families. BK filings are already factored into the loan risk. The HELL with the politicians and corporations who are behind this. My utter contempt for them only gets stronger.

    I can't say it enough. Risk is factored into the Credit Card system already. I see human beings being enslaved through Student loans, to much Credit and now this awful Bill that could easily destroy lives.

      Kill the Bankruptcy Bill--Some Ideas How to . . .

      Hi everyone, I posted these ideas the other day, but I put them in the wrong thread (General BK), so I've moved them here. Hope it's helpful.

      Congress is acting fast to move forward on enacting the so-called bankruptcy "reform" bill that will limit everyone's access to a fresh start, the basis of American bankruptcy philosophy. The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 is punitive. It puts credit card payments ahead of child support in terms of what must be paid by debtors ineligible for Chapter 7. And, under these new guidelines, if enacted, most people would not be eligible for Chapter 7.

      Congress may vote on this as early as the middle of March. They will debate it next week.

      If you are opposed to this legislation that would ruin families and virtually eliminate our possibilities for starting over, the time to act is now. It is urgent.

      What can you do?

      1) Call your congressional reps and senators. Tell them you oppose the bankruptcy reform bill. That it hurts families. That it puts cc companies before kids and punishes the men and women serving in the Armed forces. (I'm not kidding; I couldn't make this up.)

      Tell them that you when it comes time for re-election you'll remember if they stood-up for working Americans, women and children, members of the military and veterans, or whether they were bought out by the credit card companies. (MBNA was one of the largest lobbying forces behind this bill, and a huge contributor to political coffers on both sides of the aisle.) This is not about Dems and Repubs, it is about big money and selling out to it. 80 out of a hundred senators are currently planning on backing this bill.

      2) If you are part of a congregation and will be attending services this weekend, talk to members of your congregation about how this law violates the Biblical concept of forgiveness of debts (which was described beautifully by "freshstartinmo" on this forum.) Ask the members of your congregation or parish or community group to write and call their congressional reps and senators.

      3) Please email your friends and family and ask them to do the same. Let them know where you stand on this awful legislation. You don't have to tell them that you're thinking of filing ;), or you might want to.

      4) If you want to read the bill, go to http://thomas.loc.gov/ and type in "bankruptcy," "S.256," (the Senate version) or "H.R.685," (the House version.) It's not exactly a fun read, but you can see what they're talking about if you can get through the legalese.

      A final note: Please don't have a heart attack reading this. Even if the bill passes, the way the bill is currently written there will be a 180-day period before it becomes law. So you would have about 6 months to file under the existing laws. I think the lines at the BK court will be awfully long if this passes. ;)

      But please don't let this good news deter you from acting; even if you get to file under the existing law, your friends, family, and those folks serving overseas in Iraq will be denied this basic protection in the future. Don't let that happen.

      Sorry if this is a bit of a rant, but I can't stand seeing our government completely sold out to corporate interests. It breaks my heart. This is supposed to be a government by the people and for the people, not by the corporations for the corporations.

      And, if this country is still a democracy, it may be possible to stop this legislation.

        Mothersvox, you are right. However, the Biblical concept of forgiveness of debt, the year of redemption and such, which were in the minds of the founding fathers mean nothing to the beasts who inhabit Washington today. I know that the words of our founding fathers were not manna from heaven and that they had there share of deficiencies. Do you expect the Boxers, Schumers, Specters and Franks to respect original intent?

        These people live such debauched lives that they may not even possess a conscience.

        What concerns me is not only the future for the poor, medically poor, elderly and the SOLDIER who HAS to root up and GO TO WAR but I also Wonder, who will be willing to take a risk in small business. Who at this point would even join the Reserves? The offending beasts who inhabit that vipers lair Washington are using our Soldiers as political capital already, they have no regard for the common man or his struggles. If a Soldier commits any act against any "innocent" prisoner (and we know that these poor innocents we have in captivity are there only becase they got to many parking tickets) he is paraded like a dog through the media and his life is trashed and he goes to PRISON!

        These "subhumans" n Washington actually removed protection for a person who is called to WAR????!!! I don't apologize for the rant, I am damned angry and you may believe that once i calm down and can articulate it properly and firmly I will make the calls.
