    Back from the lawyer's about the lease

    A) It is a 12 month lease because we verbally discussed it prior to signing.


    B) The only remedy for breaking the lease is the loss of deposit.


    C) We do not give them any more money as we are paid through moving out day. Paying additional money is admission that we are responsible for those last three months on the lease.


    D) If the landlord takes us to court we can argue that the only remedy listed for breaking the lease is loss of deposit, nothing about having to pay the remainder of the lease or until it is re-rented.

      Yea. Bad news is he can still come after us though. It will be $750 for the lawyer to go to court with this. So, if they get the place rented in one month we're just as well to pay it and be done. We're more scared of if it takes all 3 months. Then we would have $2400 + $900 in late fee + Thier attorney fees + court costs + our attorney fees if we lost for some reason.

        Even if he rents it he can still come after you if he wants too, but probably won't...... all he's interested in is his monthly income off of it......

        He would have to prove to the Court that he "lost money" by you breaking the lease and if he rents it right off then he hasn't lost any money.....

        And yes the only stipulation on the agreement was that you would loose your deposit if the lease was broken....

        Would cost him in the long run, bad advertising for him for lawsuits to show up in the paper......

        You may be okay on this one...... time will tell....
