    My husband and I have no savings for retirement. He will have a pension and social security. I only have social security and a 401 K that has next to nothing in it since I was not at that job very long and they didn't match any savings.

  • I missed the part about your attorney working in bankruptcy for 40 yrs. That is excellent, he should know all the in's and out's and if he's been in your area for all or most of that time he knows the courts, trustees, etc well also. He knows what to expect and how to handle it.

    I hope you are not thinking about dying over this. If you are by all means get help and bring up your feelings when you have the gambling counseling set up. I understand feeling down about it and if it's "normal" down that's fine, but if you feel like you would hurt yourself seek help....

    I assuming we have to work it into the budget. It is about 16 months before money is freed up from the mortgage (paid off). I don't really like having the IRS bill collecting interest, but I feel like we have no option at this point....

    It was hard for my husband who was slightly younger than you at the time we filed Chapter 13 (I am about 7 yrs younger than him), but the positive thing is to be out of the debt by the time of retirement. That brings a certain peace. I wish you well with your counseling.

  • My husband and I are in 100% payback. I have the higher income and the payment comes out of my check because it makes sense to take it from the paycheck that has more money in it.

The banks lawyers sent the notice about the change in payment (their lawyers send us anything that deals with bankruptcy) I was assuming since it was the terms of the original loan we were obligated to follow it.
