replied to Did I hire the wrong attorney?
OK I agree that makes sense but if I were him I'd explain it. I'm going to increase my size of household to two. How do I get my plan/means test redone once I do? My fiance' has no income.
    Thanks

I live in IA which has no limit to the value of a home exemption if it fits in the acreage limits.
Should I just lay low make my payments? 5 years is a long time so many things can come about. I can't stop thinking about trying to end this earlier.
    Thanks

I asked my attorney today if he ran a new means test with 2 in household and if he ran a 7 liquidation test but he hasn't answered yet. It usually takes a week or more for him to respond.
    Thanks

Yes I did run through a means calculator at legal consumer as if I was married (wife not filing wife no income) and the results came back with a negative DMI.
    Thanks

Did I hire the wrong attorney?

    These issues I wonder about.......
    1. My attorney never gave me the option to sell my non exempt property and spend the money
    2. My attorney never suggested I get a new car before filing, my car has 100K mile s on it when I filed, it's paid for though, valued at $7000 ( iowa exempt)

My Attorney says I can't convert because my income is too high. My income is $65000 and the median income test maximum for 2 in household is $64221 so I make $779
a year too much. I would think we could make this fit somehow? He also says my home is not exempt because I have only lived in...

Ok then if my attorney says he can get me converted then I best do this as soon as possible. I'll give up the non-exempt assets.
If this would become an asset CH7 which can take many months, my trustee payments will stop while the trustee sells the assets? Thanks

When we filed CH13 my Daughter and Grand Daughter lived with me but my attorney said we'll leave them out because it's a wash. Maybe I should just wait until the 20th month (12-6-2018)?
The property my attorney said I would lose was there when I filed the CH13. The trustee raised my plan payment...

Maybe we did, my bad. I guess I'll kiss them goodbye. Can I qualify for a 7 conversion based my states income guidelines alone or is all about ability to pay? Can I change my household members for the conversion?

    Thanks

    Converting a CH13 to a CH7?

I'm reading that before filing a CH7 a person can sell non exempt assets (mine would be $8K worth) then spend the money. Can this be done in a conversion from 13 - 7?
What can the money be spent on? I need a surgery I'm putting off because I don't want the bill. I'd rather spend this money...

Also my daughter and her daughter live with me but I didn't include because I didn't want them to be part of this filing. I don't want to cause them any legal or financial troubles they are on SSI and food assistance because Mommy is mentally disabled. But if I did count them I would be way under before...

    gross income for means test

I'm on a salary with no other income. If my salary is $65K then that is what is used to calculate my income for chapter 7 eligibility or are there some deductions?
If my income is is within $1K of the maximum for my state can I still means test qualify somehow for a 7 conversion?
    TIA

I will want them again but until then I can do without them no problem. Is there a way to send a buyer after them when the trustee sells them?

He says we would be real close to qualifying for a 7 conversion based on income. He said I would lose the Harley and camper but they aren't worth much, maybe $8-10K. Seems worth it to me to get done with this $440 mo. x 60. Obviously I don't make very good financial decisions or I wouldn't be here so...

new medical bills after C13 plan comfirmation

The medical bills I had went unclaimed. I continue to go to the same health care provider but I never get any new bills. I pay the co-pay. Could I get hit with these bills after discharge? I have a surgery I need to get scheduled soon.
    TIA
