    Finally found it. The demo software stated $6213 this time, but 11 USC 547(c)(9) states $5000. However a bit further down it states debtor is “presumed insolvent” 90 days prior to filing. So, multiple ways to run afoul of this regulation....

    Thanks. I’m also fortunate if there is a non-secured creditor, and I don’t list them, in AZ with a no-asset discharge, the unsecured debt is dropped. So I’ll my best and if a junk debt collector shows up, here’s a copy of the discharge....

    My "dropping the zero" didn't mean to lie. It meant, drop the zero from the amount. Don't stuff 3k when you're only allowed to stuff 300. However, NY and Federal allow more. I again do not codone anything that would cause trouble. That's my last word on that item, delete the original if ya'll...

    Ummm, no, I specifically stated to drop the zero, thus $300, and LIST, then EXEMPT it as his one bank account. He could keep $300 not $3000. In no way do I advocate fraud, jail time, unaffordable fines, or tax evasion. I do highly recommend researching the system and using it to its maximum advantage....

    My suggestion is to put some of the settlement into an IRA so you won't lose it, as long as you follow your state's allowed exemptions. You really should meet with a bankruptcy lawyer for pre-planning. You wouldn't want to pay off an under water...

    See if your local court has a self help center. Set up a time to see them right before filing. The volunteers can review your paperwork immediately before filing, thus ensuring it is right before turning it in. You can make needed changes on the spot, even if you have to hand-write a page or two....

    The Federal 20% is a requirement for withholding. It doesn't mean that 20% of the amount is the total tax on that amount. It's just an estimate. Your tax might be 35%, 15%, or even 0%.
