    My 341 is done

Yesterday I had a phone in meeting. I was the first one called.
The trustee got a little bit testy over some 401k withdrawals I took but calmed down when I told her I had no other income for a few months, and SS income afterward.
She seemed deeply disappointed to find no assets to claim....

    Thank you guys!

It is liable to be spent in one place though...the mortgage lender.
It will get me very nearly caught up, so I won't be at their mercy when it comes time to reaffirm that loan.
I won't be reaffirming, to be accurate.

I will just 'shelter in place'...

    Thank you both!
My atty contacted me promptly, and reassured me that all is good, since it is after the conversion.

This is the first real break I have got in awhile....

Is the Universe really out to get me???

I have a 341 hearing coming up next Wednesday. This is a Ch 7 case, converted from 13.

Since January 4 of this year I have been battling with my ex-employer (I retired early this month) about vacation time earned last year, to be used in 2022.

    Today I learned this vacation...

  • I did ask my atty. about the COVID help, and he said I did not lose enough income to COVID to make a difference.
I filed the original CH 13 in 2017.

Yikes! Another 13. The lawyers bill would be more than the amount I am behind. Also, my income is now at 2100/mo. Wouldn't I have...

  • This is a FHA, originally through Chase, now being handled by Carrington. I do not expect to get a loan modification with my lousy credit and paltry retirement income but was hoping for an agreement to make up the difference over a year or so.

Would you think auto lenders would negotiate...

Wondering if I should reaffirm after Ch7?

I was in a Ch 13 plan until my income dropped below being able to afford a plan. I converted to Ch 7 and have the 341 meeting coming up later this month. I am wondering if I should reaffirm the mortgage.

I am still in arears approximately 4,000$. I would like to stay, as the payment...

Barbsi! That was an excellent suggestion about the prescriptions!
I was able to get a discount card from the insulin manufacturer that knocks the price down to 35$/month. Thank you!

Also, I have been researching an Offer in Compromise to the IRS. I am not eligible until the BK...

Thanks for the insight, Zombie. I saw on another thread you are all but done with your plan. Please accept my congratulations and admiration. It is not an easy thing to do!

Hi Carmella! This COVID twist dominates all of our daily lives.

    Chapter 7 conversion

I am converting to Ch 7. It was done early this month, and the 341 will be late next month.
The lawyer got another $1000 for his troubles.

There is 1 car I will not be reaffirming. The license expires at the end of this month, and insurance premiums are due to renew the middle of...

Here is my dilemma. I won't be able to stay at it much longer. I'm already hurting, and now these head games at work are downright depressing. My goal would be to make it to the first of the year. That's a stretch.

The conversion would be the best choice. I could do piece work here...

Well, after calming down and putting some thought into this, something occurred to me.
If I were to leave now, I would have SS and private pensions as income.
    Are these sources judgement-proof?

If so, my thought is to either leave now, or go back to work until the mortgage and...

Another good tip about ACA. I tried to find prices online, but kept getting the run around.
For now I am going to stay off work to get my foot/leg diagnosed and treated. I have been dragging it around too long now.
If my company doesn't like it they can completely flush me.
    I feel...

I did read up on SS over the past 2 days.

As far as I can tell, you have a limit on what you can earn per year if you are under FRA.
Although I have exceeded that, I am on a month to month basis for 2021 only, beginning the month I begin benefits.
    The wage limit before penalty...

    Change of focus

Today I learned the position I have held for the last 8 years is being eliminated within the next 2 months.
Of course, I can downgrade and stay working. That privilege comes with a 7% pay cut, and 12 hour days.
I am 63, and have been at the same company for 38 years. The 'new' position...

  • I can add, from my own experience, should you be behind in post-petition payment, do not call to ask what would happen to your account if you decided to convert to Chapter 7.

    Good job, VolFan!
Anyone able to complete a 5 year plan to discharge has my utmost respect.
That last payment has me curious about my own situation, should I be able to make it all the way through.

My choice would be to drag funds out of my 401(k), and be done with it. I do hate to do that. The idea is to build the account, not deplete it. I do need a place to live though.

Another possibility is to temporarily lower my contribution until its rectified.
    I wonder how the trustee...
