  • Irprn - Thank you for your response. After speaking again with her, she said she doesn't think her attorney knew about it. She's pretty confused about what transpired. For some reason, she made the decision to combine her first and second mortgages just prior to her discharge (both of which were...

  • Thank you for your quick response. I started another thread with some questions but you may know this also...

I am trying to help a person who is facing foreclosure. She filed Chapter 13 BK in 2005 and was discharged in 2008. About 4 months prior to her discharge, she refinanced her...

  • Mortgage Refinance during Chapter 13 Question

I am trying to help an elderly, disabled widow who is losing her home and I'm hoping to get some assistance on this forum. She filed a Chapter 13 BK in 2005 after her husband's death and her accident which rendered her disabled. She had 2 loans with Bank of America. Her Chapter 13 was discharged...

  • Please excuse my ignorance of Chapter 13 bankruptcies when I ask this question...if a mortgage payment is paid outside the plan, is the mortgage amount included in the bankruptcy? In other words, when the Chapter 13 is discharged, is the mortgage balance included or only those debts that were paid...

    replied to NFCU Credit Card
I haven't opened any credit cards since our discharge (Nov. 2009) and decided it was time to do so to try and get my FICO scores up. My husband and I went into NFCU and each opened up a savings account with $20 in each account (we are Federal Contractors). Then I asked when I could apply for a credit...

  • Thank you IamOld for your response. That is encouraging. Did you wait unitl you received a bill from the IRS after you filed your taxes? Did they file a tax lien against you while on the plan?

We are dealing with a lot of uncertainty right now. As I said, we lost 2 rental homes last...

  • Anyone owe IRS more than $25,000?

Has anyone set up an installment repayment plan with the IRS for over $25,000?

We have been paying $400/month on $19,000 in back taxes through an IRS installment plan. After our BK discharge, we lost 2 rental properties and now owe approximately $25,000 more in Capital Gains for 2010....

AngelinaCat and anyone on an IRS payment plan with more than $25K in taxes due: How difficult was it to set up a payment plan?

We are on a payment plan for back taxes at $400/month on about $19K. Since the amount was less than $25K, I was able to apply for the payment plan over the...

You are correct there are a lot of short sales happening these days. There also are a lot of agents going after this business. To best serve your clients, you will need to go through training specifically for short sales and should become certified as a distressed property expert. The short sale...

  • We are also in the Coorperative Short Sale program and in California. We are a little ahead in the process than you are. When the appraisal came back and BofA set the listing price, we thought it was high and we'd be in the house rent-free for a bit longer. The negotiator even told me they would...

We had a successful business for 23 years that went under. Fortunately, we saw the downturn in our business coming and had time to prepare for our real estate career. Although we have done well in real estate, our income could not support the 5 properties we purchased when our income was much higher....

  • Equifax and Trans Union are reporting correctly. Only Experian is reporting incorrectly. I sent them a letter, a copy of my discharge and a document showing my filing date. If this doesn't work, I think I'll also send an email to the Executive Offices of Bank of America and Chase and see what happens....

It bothers me so much to hear this but I know it's true. I am a Realtor and I have to deal with these pushy agents too. But please know, there are a lot of ethical real estate agents out there who are professional enough to put their client's needs first. They are working hard to help their clients...

  • Thank you for your responses. Now I am working on getting BofA and Chase to take off the late reporting after our filing date. According to my attorney, the last month of reporting should be the month of filing. I already disputed this on-line with Experian and they would not remove it. Now I am...

  • Credit Reporting for Ride Through Mortgage

We were discharged of our mortgage in Chapter 7. We did not reaffirm but was granted a loan modification while in active bankruptcy. The loan modification went into affect right after our discharge. On my husband's credit report, it shows the mortgage loan with a zero balance and "included in...

I'm curious if anyone knows...would the status of "agreed settlement short of full payment" or "incuded in bankruptcy" have a more positive affect on the credit score?

  • When the NOD was filed on our house, we came home to find a bag of micorwave popcorn with a couple of Realtor's smiling faces on it with the note "Just popped by to see if we can help". It was so insensitive we just had to shake our heads and laugh. Funniest part is, we are Realtors too...

  • Violation of Injunction Post Discharge Question

I'm trying to determine how violations post-discharge and pre-discharge differ as far as filing complaints and santions to the violating creditor. From what I've read, the santions for violations pre-discharge (362 violations) are pretty clear cut but sanctions for violations post discharge (524 violations)...

  • This is very interesting. Please let us know the outcome. I'm curious, how much money are they offering you at close of escrow if you do a short sale? I've heard $3,000 and $2,500....

  • Bank of America is trying out a pilot program called the Coordinated Short Sale Program. It is very similiar to the HAFA progeam. They are pro-actively reaching out to a select group of past-due borrowers (I've heard only a few thousand so far). I know they assign a dedicated account specialist to...
