    After filing, the bk law provides 90 days after your 341 for secured and non-secured creditors to file claims, and 180 days after filing your case for government creditors (i.e. IRS) to file claims. Creditors can ask the court for more time if they can prove their legitimate need to the judge.

  • In truth your current Ch 13 attorney met the terms of the agreement you made when you retained him/her so according to the law needs to be paid for the services provided. That means that you do owe whatever is left of the $3K minus what's been paid through your plan so far.

    Michigan is the only state that bases your plan length off your confirmation date, not your filing date. That's why you are being told you need to keep making your payments until June (your confirmation month) rather than Feb (your filing month). Sorry to be the bearer of bad news

    I fail to see why your lawyer told you that if you bought a new (to you) car with your trustee's permission, your trustee would then refuse to allow the transportation and car ownership costs associated with the car.

    All your lawyer has to do is modify your plan to include the new car...

    Your 100% 13 plan for 60 payments was originally crafted to include all your unsecured creditors filing claims. Since that didn't happen, then yes, it is possible that your case will end before 60 payments have to be made. Ask your lawyer to confirm this may be the case in your situation.

    Ask your lawyer. He/she knows what the practice is when asset payments end in your local court and how your trustee treats the situation.

    Some trustees will petition the court to increase your payment by adding on what you were paying on the car payment. Other trustees could care less....
