  • You will continue to have those worries until that 341 meeting is done and over. Then you'll be back here saying what the heck did I worry for? The purchases you made were everyday living expenses, not high ticket luxury items so, as everyone has told you, just stay calm (I know it's hard) and...

  • Time2Change - sounds like you had a good meeting. I understand your head spinning, etc. but all I can say is relax, your attorney sounds like he knows what he's doing and is
doing a good job for you. That is great that you will be done in 36 months and nothing wrong with not paying back 100%...

  • carmella13 - Good point. I use INFORMED DELIVERY also and it is fantastic. It wasn't available during my BK but it would definately be of value to those going through the process now.

  • All's well that ends well...i too am glad everything worked out. I remember my first appointment with my attorney. It was the first (and only..touch wood) time that my car wouldn't start when I headed to the appointment. It also worked out just fine. Good luck going forward.

One other thing, is that the actual claim amount (different than your scheduled amount) is usually due to interest being added to the amount owed up until the date of filing. As LadyInTheRed said the scheduled amount is probably based on statements you gave your attorney. There would've been interested...

  • Anything I received regarding my case from the trustee or attorney NEVER came certified or registered. Anything I received from the trustee also went through the attorney who also sent me a copy. Maybe express your concern to your attorney and see what he/she suggests. As for your creditors, you shouldn't...

  • I agree with what muneco wrote above. You can also ask your attorney if the trustee has a website that you can look at (almost the same info as NDC). Just be cautioned that you're not going to see mistakes..the trustee pays the claims in whatever way he/she decides (and is allowed to do so). Sometimes...

  • Hi and welcome. You have basically covered the issues of the "keep your head down" wording that you've seen. Personally it's a phrase I dislike...do exactly as you said but if you have any questions/concerns that you need help with do talk to your attorney and, if your attorney doesn't respond,...

Then so far, so good for you. I have to say that is strange there was no confirmation hearing..that would normally show in Pacer. I would for sure ask your attorney about that. Once every one files you should receive a list of the claims from the trustee. The agonizing is something everyone on this...

Hi @Stephie14 - Welcome to this site and to taking the step to get your finances back in order. The confirmation of your plan has nothing to do with whether claims have been filed
yet or not. The confirmation is for the judge to agree to the plan that has been submitted on your behalf by your...

hcorreia1 - are you in a 100% payback plan?? If so, talk to your attorney about getting permission to do a refinance. If you are already paying 100% the trustee should NOT take
the savings. That's only for a 100% plan (I know because my attorney talked to me about it). If you are in a less...

  • Hi. Are you in chapter 13?? If so, you probably want to do that second class either a) ASAP - once it's done you don't have to think about it again OR b) before your last payment is made. The class has to be done or you won't be discharged.
As for your credit, no, it's not pulled again before...

  • Hi Robin, your monthly plan payments are NOT reported to the credit bureau. Your score will be lower while in your BK, but once it is completed you will see the score jump up. It won't be a perfect score, but it will be a good starting point for going forward.

I don't have personal experience with ESOP...but as a retirement account, I would say YES it's exempt. Good luck as you move forward in the process.

Hi again Time2Change ..it's no fun when the picture and the person don't match (I find that a lot with real estate agents..i joke that they must've used their high school pics for their cards).
He sounds gruff, but if he knows what he's doing (and you have to be the one who feels that he does),...

As Switch said if the creditors don't file, it is no longer owed and no they can't come back later to get it. I maybe a couple typos in my post above. I meant to say "a few creditors did not submit a claim" and because of that and having saved during the plan we were done in 4 "years"...

Hi and welcome. I think you've done a good job trying to estimate your payment...and yes you are correct, what you will pay on the credit cards is what is owed at the time of filing. The nice thing is that there is no more interest owed. Every trustee handles things differently so your calculations...
