    Second time's the charm...

    Howdy, folks.

I initially filed Ch13 in Dec 2019. We were going along fine, then my husband lost his job over the summer.

Right away we contacted my BK atty to contact my Trustee to allow us to temporarily stop making payments. During the 2-month payment hiatus my husband...

  • Yes, the payment went down substantially. We were in a 100% plan.

    HOWEVER

The process of reducing the plan payment took several months. For about 4 months we paid the higher amount until the Trustee was finished with his part of the process.

  • Hi, and welcome.

The Ch13 monthly payment is not dependent upon whether or not creditors show up to your 341 meeting; it is dependent upon which creditors file proofs of claim with the court.

In our case we had nearly 35% of our total credit obligations "erased" by...

Hi, Carmella. While your 13 is still ongoing I don't know if there is much you can do to handle errors on your credit report. However, after your discharge there are some things. I found a blog I really like that has an article on just this subject:

Thank you so much for your thoughtful response. I appreciate it. I admit I was a little surprised by your response as by Jan 1 we will be *substantially* below median, if he is still unemployed.

I need to look more into what might catch the attention of the UST, and how to deal with such...

Will file Ch7 in Jan 2022

Due to my husband's unemployment, we dismissed our Ch13 as we could no longer afford the payments.

Our attorney is going through our bank statements and listing a bunch of stuff she says the Trustee will really focus in on. For example, every month I place an order for nutritional supplements...

  • Here is my update.

Monday we filed a motion to dismiss the 13

Wednesday evening I got an email from NDC letting me know my 13 was dismissed.

Today (Thurs) we had a Zoom meeting with our attorney to gather all info so she can prepare the petition.

    Dismissing Ch13, going into Ch7

    Filed Ch13 December 2019, 100% repayment

After making 19 on-time payments to Trustee, my husband lost his job.

We contacted our attorney who worked with the Trustee to get us 2 months' reprieve on payments.

In the meantime our income for the previous 6 months has...

  • It does seem outrageous that the federal government can essentially strip away a person's ability to earn a living with COVID lockdowns and restrictions, and then not allow that person to file Ch 7.

Another change in BK rules I would like to see: ability to discharge student loans in B...

Ch 13 to Ch 7 conversion

Howdy. I filed Ch13 in Dec 2020. I have made my monthly payments in full and on time every month since then. The Trustee granted us a hiatus for August and September, so we got a 2-month break from the monthly Trustee payment.

My high-earning spouse lost his job in June.

    As...

It's good you have a plan. You're getting closer and closer to the finish line!

I have the same issue with PACER. It's not intuitive at all and I don't really understand it the few times I have looked at it.

I signed up with National Data Center NDC.org and it's MUCH easier...

Hi there! You must be forthcoming about all your income. Does your sister live with you? Why is she helping to pay your mortgage? Omitting $1200/month in income in a BK case could get your case thrown out and could even come with criminal penalties.

Do you have a lawyer to handle your case?...

I suffered a head injury several years ago when I fell in my house and hit my head hard on the corner of the wall as I went down. I don't have any advice for you re: legal issues, but I do have advice for your health.

  • Hi! Welcome. I don't have an answer to your question but I will tell you that this is something for your attorney to handle. Very few Ch13 cases get approved without an attorney on board. This sounds like a very case-specific issue that needs professional legal guidance.

    Good luck! Please...

Ask your attorney. My *best guess* (I am not an attorney or a subject matter expert) is that since you're so close to the end and are in a 100% plan there should be no issue with your Trustee giving permission.

  • In my case there were several creditors who didn't file PoC. I am also in a 100% plan. In our case we had to file paperwork through our attorney with the Trustee in order to modify the plan. There was, of course, a fee associated with such filing (attorney fee). It dropped our monthly payment by a substantial...

    Can I convert from Ch13 to Ch7?

My husband lost his job today. We have made 18/60 payments toward my 100% Ch13 plan, all payments on time in full. On Monday I will call my attorney and see if we can convert. In the meantime, I am interested in hearing your stories of conversion to Ch7 from Ch13.

    My biggest concern is...

Since we have already done several refis before I filed Ch13, and I wasn't on any of those notes, I think it's safe to assume I won't need to be on the next one.

Thank you for your thoughtful responses, all of you.

It is not currently and will not be FHA.

I am on the deed but not the note. My attorney has stated multiple times in writing that we don’t have to file any paperwork with the court or get judicial approval to refi because...
