What I mean by protection is like with taxes, you cant discharge them if under 3 yrs old or my DFAS debt that had to be older than 5 yrs old. Both are 2012 or older. Since AAFES is government supported, didn't know if they had any type of protections against bankruptcy. Which if they did, I am sure...

Basically, what Im trying to figure out is do they have to immediately have to send a refund the minute they find out about the stay or do they have a window of something like 30 days, 60 or even 90 days or if even ever and requires a court order. I am sure the info is there, but like I said, I simply...

The debt is AAFES/military starcard. Which is considered unsecured and past the point of protection for them. So legally they do have to give it back. Im just wondering what, if any, the time frame is that they have to give it back. From what it appears, they took it a day or two before receiving notice...

My atty had me pull my experian when I supplied all my paperwork and he pulled his own as well. Not sure why though. But I am guessing the very most current one and from whichever one you want. I would wait on pulling them until you atty says otherwise. Using it for remembering bills, CR aren't 100%...

    Garnishment after filing

So I apparently missed a filing yr and had to file my taxes to file my bankruptcy. I had a refund coming back and it was intercepted before the creditor got updated on the automatic stay. All I have found was it had to be paid back immediately, but those where all by a general google search and nothing...

No guarantee that you will be approved or get the credit limit you need and if you did, could max the card right out. Probably best to pay cash.

I filed on 18 Oct. My atty told me if I were to do that, unless I was spending thousands before would be questionable but catching up on needed things would be ok. I usually like $600 of food in my house. Caught up on utilities. Have some vehicle maint. The trustee understands there will be catch up...

First off, sorry for you losses. I live in the country where people have a few plots and let family build houses on that land (if it meets the requirements). It sounds like to me that the bank had a lien on the properties when you FIL passed away. He may have deeded to you, but you didn't outright own...

Unfortunetly, it may not be an option. There is a gray area. My mom paid for my filing. If it was a loan, I had to list it and it gets discharged. The other option its considered a gift with no intention of paying back. Even my atty told me that they know we pay our family back despite what we say but...

Ok. I was just worried that maybe my attorney messed up and didn't include them. So just for a recap in my stupid terms, even if its not seen in any report, since its unsecured, no asset CH7, its included already? Yeah in PACER and what my atty turned in, none was listed at all (other than my other...

So I went through my PACER account and noticed none of utilities are included save one. Why is that? There is one that I do want gone. Face it, the reconnect fee and down payment is far cheaper than playing catch up. lol

Even with it being governmental, it will be discharged. I also believe any return I get this yr is safely exempted....

Yes, it was included. I figured either they didn't get the notice yet or just didn't. Not alot of info for the lawyer to use other than name and debt. So thats why I figured I would call first since I know it was probably an honest mistake. Then if they played hard ball, give it to my lawyer to tackle....

Welcome to the forum. I am a recent filer. First thing first. You need to consult a lawyer. Most first consults are free. As for owing family. Doesn't matter. It will technically be wiped out in the bankruptcy. EVERY DEBT has to be listed. Family debts are more of under the table payback AFTER you are...

Who has dealt with Military Star Card/AAFES

So I filed on 18 OCT 2019 and already have my 341 meeting in DEC. When I filed, I realized I didn't file my 2016 taxes. I just got a letter from my state saying my state refund was intercepted to pay that military CC. They probably weren't updated on my BK filing. It was my understanding that they...

Thank you for the prompt input and was excited to see that you responded. Ive noticed that you have a lot of info and are quite helpful here. Yeah my scored dived as soon as I was told to stop paying but started rising back up as the creditors update my accounts. As for the 2 kept loans and Navy Fed.,...

Justbroke, I have a lawyer. As for the two loans, yes I am reaffirming them. My question is, what will my credit report roughly rebound to since I have 2 reporting postive and not be heavy hitters like a mortgage or a $10k+ auto loan. Its all I can seem to find though.

    Navy Federal repayment...

    New filer here

I just filed on 18 Oct and got an email with my 341 on 5 Dec. So a couple of questions. I will have two secured loans that I had to keep. One is at $1200 a month @ $115 a month (Secured by household items and my work tools, I am a mechanic so needed), and the other is Snap On (I know I know) thats over...
