    HI
If you have had your consultations any lawyer would have pointed out that there is a line for other regular contributions... not disclosing regular money coming in is fraud. Will her contributions put you over the limit?

you mentioned cashing the checks. If the money is a...

  • I never believed in age discrimination until I turned 41 and found my well qualified self still unable to get a job.... Not using it as a crutch, I will find a good job, but the discrimination is all to real! I truly always thought it was BS.....

I always say make sure every dime is in your schedules. Having said that, the one thing that has surprised me a lot in this process is how little things have actually mattered in this process when compared to how I thought it was going to matter. I suppose this is trustee by trustee though

  • Potential fraud is absolutely a reason for filing an adversarial proceeding. Does this mean they will? Well that depends on the creditor. these things cost the company money. They have to decide on their chances of proving you committed fraud.

  • I'm confused. Did you reaffirm the house in your bankruptcy? If so, that's a prime example of why many on here warn people not to reaffirm anything (not to call you out). If you didn't re-affirm, your life is a little easier. If you did reaffirm, I suppose you could file a five year chapter 13 to give...

Yes the idea is to have as little disposable income as possible to stay in a seven. You have to be honest, but there are a lot of expenses you may not be considering that will fly on the pprwk. Good luck.

@ anderson I am not sure she "Wham" made it an asset case. Many on here have stated that they knew at the 341 if the trustee wanted any of their stuff or a buy out amount. In my case I assume she needed to research some values independently and determined that I had about 1700 or some number...

So, a serious weight has been lifted. I am going to have to pay the trustee about 1700 bucks to maintain all of my possessions. That is amazingly fair. I even had the option to pay over for months if I had wanted to....

    Hi Bob,
Those using the homestead in Florida do not have a wild card exemption, and the personal property exemptions are notoriously low. 1K for each of us 2K total. I am certainly not complaining because I have a TON of equity in my homestead safe thanks to the Florida laws. I just want to pay...

    Converted to an asset case

No clue what the trustee is after. We do have a second house but owe way more than it's worth. 100% of homestead exempt in FL. Hope I know what's up soon.....

  • Lostall do you know how utterly ridiculous and out of touch you sound?? "My reasons for suicide are better than his"? Give me a break! Life is about perspective. So you lost 500K to his 50 K? Big deal. Others have lost much much more than you. The amount is irrelevant. That 50k that caused...

  • There is nothing to explain to your trustee unless asked. Fill out your paperwork honestly, if they have questions about it they will ask. Worst case scenario the trustee will go after the lender to recoup the money and re-distribute. It won't affect you at all especially since it wasn't an insider...

Best story ever I love it when these folks that go far beyond "just doing their jobs" get screwed. If they repo man is following the law, it is what it is they have to feed their families. When they are willing to break the law and do the shady crap that happened to you, I am super happy...

  • Trevor,

I appreciate that you have come here for points of view, and you have been humble in listening to everyone's points of view. What you proposed as a "what if" here just doesn't pass the "smell" test. I dont want to put words in Des's mouth, but I think his point...

  • The only thing you may have to do is increase payments for the last few months based off of your increased income, you would not have to start from month 1. That would really suck ass honestly by the time everything works its way through, the increased payments may be quite short in duration. Congrats...
