    This is what happens when you sign loan documents without reading them. Although, has anyone ever requested to read all of the loan documents or have an attorney review them before you sign them? Anyways, trying to prove Non-Disclosure can be difficult. If it's written on any of the pages, it's legal and binding. That's why you always have the 3 day Right To Rescind. If you don't like something about the terms, you can negotiate them, or take your business elsewhere. Either way, I think you're stuck with the terms and interest of the loan.

    As far as the bank not speaking with you and instructing you to consult with your lawyer and/or their lawyer(s), then that's their right. On the other hand, any inquiry or letter you send to them must be answered in a timely manner. Your job is to fight for your rights, but it's their job to protect themselves. Crappy way to do business, I guess, but fact of life.

    There are ways to fight these sort of discrepancies, but you gotta know what you're doing or else you'll get buried.

      You're having to deal with different people at the bank because you're under Automatic Stay protection of BK.

      When you filed, your acct should have been sent to a special BK Dept. Most larger Creditors have a Dept of people specially trained in dealing with accts that are in BK. Those reps know what they can and cannot do with your acct or say to you as prescribed by Federal BK Law.

      That's probably why they are finally telling you now to have your attny talk with their "legal people". By the bank reps even talking to you in the first place, while being "nice", they were really in violation of the Automatic Stay.
