The trustee is willing to confirm my Chapter 13 plan, but want language in it where she will only pay the arrearages on my home if the mortgage company files a proof of claim.
The mortgage company has not filed one yet and the deadline is October 3, 2006.
What happens if it is confirmed and they don't?
Is the arrearage discharged but they still retain the secured lien on the property? My attorney says not to worry and he hasn't returned my call yet.
