    Question regarding dismissal

    I'm confused here about the rules regarding dismissal. We haven't had our 341 meeting yet but I was reading here that even after dismissal the trustee can still "audit" you for a year or 2. What does that mean exactly? Can you not start your new life after dismissal and get i.e. a savings account, etc. And how exactly do the keep track of you?

    Do you mean Discharge, Sophie??

    Dismissal means your BK Filing gets dropped by the Court. No Discharge. You still owe the debts.

    Dismissed with Prejudice means you cannot refile. Dismissed without Prejudice means you could possibly refile.

    Discharged - 12/2006
    Officially Declared No Asset - 03/2007
    Closed - 04/2007

      You most likely mean Discharge. Yes the trustee can reopen your case if he finds evidence of fraud. No that doesn't mean you can't start your life again, it just means if you tried to hide money, a car, a house, or whatever you could still be punished even though your BK is done and over with.
