    marriage question?

    I am getting married soon, or wanting too... 2nd time for both, and was wondering.. can we get married and will I still be able to file bankruptcy without involving my husband or should I do it first with my name as it is now? my problem is I make less than 40k a year and the lawyer said that I have to be under 20k for the 6 months.. before I can file chapter 7 and with mandatory OT I am above the 20k for 6 months.. so I am waiting for it to drop under the 20k .. the OT has stopped but my income might not dropped down to the 20k until the end of the year and we are wanting to get married.. thanks for any help you can give..

    The paperwork would be simpler if you file before you get married, but you can file solo once you are married.

    To file seperate of your spouse, you'd start out with both incomes. Later on in the paperwork, you (or your attny) would deduct out your spouse's income. You'd also have to divide up the bills and such. Who pays for what to figure your expenses, household goods, and such for exemptions.

    Filing BK can be done either way.

    Did your attny advise you go one way over the other??

      Is there a legal reason you want to get married right away? It sounds like it would be in your best interest to wait. Since your emotional commitment won't ever change, wait until your bankruptcy is over before getting married.
