    help !!

    Just wanted to know if anyone can tell me how long after you stop payments on cc will they ( the cc companies ) file a judgement against you ? I have been getting calls from a "so called" lawyer ( the caller id box shows its citicards ) asking me to make a payment today over the phone for $ 9,000.00 ! YEAH OKY !!! :p LOL when I refused he said he will see me in court... I haven't made a payment to them since Dec. 2004.. will they really take it to court this soon or is it a scare tactic ? I have a meeting with my lawyer on Thursday to talk about us filing Bk. Just wanted to see if this happened to anyone else and if they really can do this to us so soon! Thanks so much

    Shygal, I think we've been getting calls from the same guy! In my case, as I posted elsewhere on this forum, someone called and pretended there was a problem with my SSN, didn't say they were calling in regard to a collection, and thus lured me into returning their call. They were a company called United Collection Bureau, allegedly hired by Citicard.

    When I didn't agree to immediately pony up $7000 that I obviously don't have to settle the $9000 debt--otherwise I'd be paying the minimum payment--someone from the company called back and was yelling into my answering machine, threatening to expedite suing me, and so on. It was really creepy.

    I posted about this elsewhere on this site because it really upset me.

    From what Todd and others have said, this is usually a scare tactic. If you were to be sued, you would have 30 days to answer the complaint. Then it would be 30 days until the next step. So typically you'd have about 60-90 days from the receipt of a complaint to file for BK before any judgement could be rendered against you. From what I understand, it would be easier to file for BK before a judgement is rendered, but even in the off chance that they could get a judgement before you filed, the judgement is also discharagable in BK. I am not a lawyer, so double check this last bit. I think Todd has info about this. Also, it costs them money to sue you and so they are likely to end up with less than nothing.

    These are scare tactics. And Citi seems to be among the worst. I find them appalling. I had an account with them since 1987 and NEVER had even a late payment until this October, and they are just all over this like flies on . . . well, like flies on you know what. ;)

      Thanks for the reply... I hate citicards .. who do they think they are! I am meeting with my lawyer to get things rolling here... short on some cash so its going to be a bit
