    credit score in Chap 13

    Just got a copy of my credit report. We have been in our Chapter 13 plan since April of 2004. I had 2 vehicles included in the plan. Both finance companies reported late payments, anywhere from 30 to 120 day lates, for the first 5 months or so of the plan. From that point, one of the companies has not reported any lates while the other has continued to report lates, mostly 120 day lates, EVERY month that we've been in the plan. A loan officer told us that could make a difference of 100 points or more in our credit score. Should my lawyer be able to do something about this. Can I do something about this? We are still paying the interest on these vehicles as and unsecured debt, buy we've made all of our payments in the plan. Anybody else experience this? Is this common?

    Yes, I believe you have a case. I would visit the credit repair section and see if there is some similiar cases. Not only are they violating fair credit reporting laws, but also by reporting you as late, they are violating the automatic stay. I would send them a request to correct this error / otherwise, you will file a case in the bk court which will include attorney fees and the $1000 fine. Good luck
