Joining the "club"

I haven't posted in awhile. We retained an attorney at the end of August and have been compiling the mounds of paperwork we need to file. We own an LLC and had to get a bunch of stuff together for that.

Anyway, we meet with our attorney next Wednesday to sign the final papers (and pay the balance!) and he said our filing will happen shortly after that (a couple of days). We are anxious to move forward, but a little worried because of the business. If it weren't for wanting to keep the business, we would be filing a Chapter 7.

Anyone have any experience with the Upstate NY/Syracuse trustee. Our attorney thinks our case is pretty simple because we have a huge debt (about $100K all unsecured) and low income.

I guess we will see soon enough.

Ok, here goes.
Got behind in my mortgage, was sort of kind of paying everything else. Tried to work out a deal with the mortgage company, but they wouldn't work with me. Also had unfiled, unpaid state and federal taxes from years back -- 3 years, I think.

So I started investigating Ch 13 in order to keep my house.

Found a really good lawyer in Syracuse -- not sure if we are allowed to mention names here -- PM me if you want to know the details of that.

Had my meeting with him, he told me what it would look like, what would probably work with the plan....seemed do-able, so I filed in April.

I am paying secured back at 100%, of course.

Unsecured at 4.97%.

341 meeting went smoothly. The trustee we had (again, not sure if we are allowed to mention names) was wonderful. No problems at all. No objections, nothing was mentioned about income tax refunds or making additional money in the future or anything like some other posters here face.

If you want more details about my exact budget, please let me know. It's not as bad as you first would think. My plan is a 58 month plan, and I pay $611 a month. I opted for payroll deduction. So I've paid May, June, July, August, September, and soon to be October. Time is flying.

Also, get a Pacer account, and look at other cases.

Since I've filed, I've had other expenses, but I don't want to go back and amend my plan -- like now my daughter is added to my car insurance, so insurance is higher. I am just trying to get by with the original plan, and not have as much for stuff like -- home repairs. Dry cleaning. Stuff like that.
