Confused about exp. date & plan term discrepancy

We filed for Chapter 13 in February 2006. Our plan was confirmed in May 2006.

I just looked for the first time at our trustees site and the following information was there and has me a bit confused.

It says "Date Closed" November 2009, with a plan length of 37 months. Yet it also says "Plan Expiration Date" of May 2011.

The expiration date of may 2011 matches up with the 60 month plan that I believed we were in, yet the "37" month and "November 2009" clearly shows another plan length.

Is there something I am missing here as to what our true plan length is?

It might be that not all your creditors filed proof of claims before the deadline...so their claims do not get paid through the plan and are discharged. Thus, the trustee will have received enough money to pay all "filed" claims by month 37.

Next time you go on PACER, look at the Claims Register, it will tell you which creditors filed proof of claims.

HHM - What happens if no one files a claim? I checked in PACER under Claims Register and no claims have been filed. I am in month 13 of 36. Also, according to the NDC, I'm at 100% payback, but within the plan, I am really paying back 33% of the total amount of our debt.

Without more info, I don't know what to tell you...if you are in month 13, someone is getting paid something. Did you have secured creditrors in you plan, i..e mortgage arrears etc.

No, only unsecured. Under the NDC, there are a few claims that say "unsecured" and others than say "unclassified". If I'm not mistaken, the ones that say "unsecured" are claims that were transferred from the unclassified debts, ie, from BoA to Sherman Aquisitions.... I don't know if that helps. My total debt amount is $44K and I'm paying back only $18K.
