Hey, we received our discharge recently and we coudl really use extra money for Christmas. I was wanting to go out and get a part time job. Does anyone know is this is allowed? Obviously, when we figured our income on our chapter 7 we did not account for a part time job. Does the trustee, bankruptcy court continue to track your income after you have been discharged?

Not only can you get a part time job after being discharged, you could have gone out and got a part time job the day after you filed for BK.
Don't worry, any money you earn from employment that occurs after the date your FILE for BK is absolutely yours.
On a side note, I am glad you are thinking about a way to "earn" money to pay for Christmas...instead of trying to charge it on some credit card, that shows some sound decision making on your part.

Yes it's OK.Any money you make from now on is free and clear.The Bk Court only looks at the 6 months worth of income prior to your filing BK.After that it's all yours to do with as you please.

HHM, wouldn't it look suspicious if suddenly your income would increase right after you filed? This confuses me too. The tax refund was money you earned but was withheld
The trustee would take the portion you earned in the months of the year before you filed, the rest would be yours if it is done correctly. (75/25% if October filing, for example). Unless you can cover it in exemptions it is part of your BKestate.August '05 Business failed.

A tax refund is really your disposable income that you over paid to the IRS and they are giving it back. Now you have all this money that's part of the estate unless it's less then your cash exemption.
I am just wondering why some here posted that the trustee asks for the most recent paystub. I can understand a chapter 13 to verify income to support the plan, but why in a 7?

you could win the lottery after discharge and legally it would mean squat.
once discharged - they don't devote any more manpower on your case unless there's fraud. If not - it's kosher.
remember: hte purpose of bk is to GET BACK on the right track and start having money again. Not continue to be broke and poor.

With Ch 7, if you win the Lottery, come into an inheritance, or have some other sort of windfall within 180 days of filing, that money becomes part of the BK Estate. The Trustee can sieze it on behalf of the Creditors. And as Bobby's Girl said, the Trustee can take a prorated portion of the Debtor/Filer's income tax refund.
With Ch 13, the whole time you're in the payment plan, your Estate is subject to the Trustee's whims. Some Trustees scrutinize every income tax return each and every year you're in the plan. Some don't. Just depends on luck of the draw. But the Trustee could potentially know if a Debtor/Filer takes on an side job to earn extra "disposable income" for the Holidays or what ever.
In our case, our Trustee wants to see our '06 income tax returns next spring. If we had a significant change in income from what we said during filing, I'm sure our Trustee would notice.Filed Ch 7 - 09/06
