    Questions about Schedules C etc

    Hello all

    I am filing pro se and wondering if someone could help me with a few last minute questions. I have filed last Wednesday but have a few schedule issues to clear up.

    First, On Schedule C it asks you to officially exempt your property using the appropriate Code. I used only Federal Exemptions. I reside in PA. The Bankruptcy Petition Preparer checked the second box on the top of the form. To me the first one looks like it should be checked. Am I correct?

    Second, Are student loans to be listed as Priority debt on the appropriate Schedule or just schedule F?

    Are month to month obligations like no-lease rent and storage units considered Exectutory Contracts and unexpired leases? thanks Diane143

    Student loans are NOT priority, they are simply unsecured debt that is non-dischargable, so you list it with all your other general unsecured debt.

    Yes, pretty much any rental is an Executory contract.

    As to the exemptions issue, that is a legal question concerning PA law and should be directed to an attorney.

      Well, I do know that PA has the option that we can use Federal Exemptions but I was not sure of the wording used at the top of the form. It is an explanation of the difference between 522 (b)(1) and 522 (b)(2). 522 (b)(2) was checked and I am using only Federal Exemptions. thanks for the other info.
