    post discharge- vehicle questions

    We were discharged in Dec. 2004. Before this we had contacted citifinancial who gave us a loan against our van a few months earlier, about making a "deal" on purchasing our van back. The loan was over $10000 and the value of the van was about $2500. (High miles, needs work but we can do all the work ourselves, just didn't in case they repo'd it.) They said they would get back to us with an offer but never did. They said they would send papers to our attorney reguarding the situation and also didn't do that. Obviously we still have and are using the van. After the discharge, my husband had to have surgery on his shoulder which will keep him off work probably 3 months and s&a hasn't kicked in yet, nor will workers comp pay. Point being, we have only my small income of 34 hours a week at $8.70 an hour. Not enough to get a loan for another car (IF we could find one) nor enough to afford a payment right now either. I recently checked our credit reports and all show this loan as being open and UNSECURED. Isn't a lein on the title secured loan? I know we have to clean up our reports so, do we just turn over the van and do without a vehicle (which is going to be a major problem- we both work 30 miles one way from home and different shifts so we'll need 2 vehicles)? Right now I am using the van, but when he returns to work, we won't have another car. The one we had is completely shot.
    Or should I try contacting citifinancial again to try and work something out? We contacted an attorney and he said it was up to us. Can someone out there help us out with some information? I am worried sick, afraid we won't have a vehicle and will lose our jobs.

    I would call Citifinancial again and make CLEAR next steps. Otherwise, I think they can come get the car.... If they have no intention of getting the car, I would contact the credit bureaus and tell them debt was included in BK, if indeed it was.

      Of course, we are afraid of what they are going to do- take the van. I guess we have no other choice but to call them again...

        I just rechecked one of our credit reports. It says open/current, was a charge off.... anyone know what that means?

          Oh, that means the debt was charged-off as bad debt. And from what I know, they don't expect you to pay. You might be in the clear with the van... I hope someone else posts because I don't know if you can legally drive it without paying, IF it wasn't included in BK...

          Thoughts???
