    Info Needed....help!!!!

    Information desperately needed, we have checked with a lawyer and he doesn't even know how we should handle this!!!! My husband & I are having to file Chapter 7. My question is: Three months ago my husbands mother gave us $35,000 to help with bills until he got a new job. $23,000 was left after he received a new job. So we gave the $23,000 back to her. Now we are getting ready to file Chapter 7. Will that affect us in any way? we still have things that need to be paid; such as car ins., helath ins, home ins. & our daughter is needing wisdom teeth removed. Should we leave things as they are or take back the $23,000 and pay of the insurance and have surgery for our daughter, before we file? How should we handle this on the Chapter 7 paper work? Will they ask for this money back from her? Any information would be appreciated!

    Your best bet would be to let the money remain with your mother-in-law, and just have the attorney work up your Chp 7 petition. The last thing you'd want to do is demonstrate solvency. Just pay your fixed monthly expenses..........and dont pay your medical and credit debts.

      Also, you want to put some distance between the time you gave the money back and you file. I assume the money was in a bank account so there is a paper trail of the transaction. You want to wait AT LEAST 3 months, but 6 would be better.
