    Filing Chapter 7/shared Accounts?

    I am getting ready to file Chapter 7. Many years ago my mother, who is single & I am the only child, put me on her checking/savings accounts. I have never wrote checks on these account or withdrawn any money from these. Will this something I will need to disclose on my Chapter 7 petitions?
    Any information will be a great help.

    if you never used and none of your money is in the account, then you don't need to list it.

      If I don't list it, is there a way that this account could show up under my social security & if so what would you tell them about not listing them.?

        Its actually fairly difficult to find out where someone banks if you have no starting point. Your bank is NOT reported on your credit report. I have spoken to a few P.I.'s about this, and they tell me it takes a good bit of legwork. If you have never written a check on the account, or deposited any money in the account, you should be fine. The trustee is looking for YOUR assets. If none of the money in the account is your's, there is no asset of yours in the bank account.

          In the interim before filing bankruptcy, should I have my mother take my name off of her accounts? or would this be necessary?

            Bankruptcy/What to do

            In January 2005, My mother gave me 35,000 to help with bills. On March 14, 2005, she needed the balance returned to her. I had 23,000 left & returned it. How do I show this when filing Chapter 7? (The 12,000 used on living necessities). Not sure how to show the 12,000 used & the 23,000 returned. Need to file Chapter 7 asap, but concerned about waiting for the new Bankruptcy laws to pass. So what if we deceide not to wait the 3 - 6 months waiting period after giving the 23,000 back on the 3-14-05? Thanks!

              The earliest the BK law will become effective will be October. So you have some time.

                Waiting 3 to 6 Months

                What is the signicance of waiting 3 to 6 months after your last cc charge or transferring money back to someone that loaned you money?

                  if you run up charges and then file BK it looks like you are fraudulent and if you pay back say a family member or friend and the trustee finds this out which he will if you disclose evrything he can force them to give the money back to you and then take part of it in your settlement. If you file BK you want it to be a clean as possible and not raise any flags cause they will dig into your bank statements etc.... if you give them reason to.
