    Phone tapped?

    Anyone hear if that could even be a possibility? Someone at work told my husband that he heard that trustees actually tap your phone when you're in a bankruptcy. Is this just garbage talk?

    The only way that I could see this even remotely being possible is if the FBI gets involved in investigating the case for fraud. I sincerely doubt that this happens in regular consumer bankruptcy cases.

    I'll see if I can find anything via google....

      Honestly, that is way out there. Sounds like a "know-it-all" thing to say. I wouldn't listen to "someone at work". The Trustee hunts assets, that is done with documents, most of which you supply. of all the concerns during BK, phone tapping is way down the list, far below Portuguese Whaling practices.

          Not to mention the time and expense to listen to all of the calls of everyone filing bk on the off chance they might hear about some hidden asset? Seems very far fetched to me.

            Well, after the whole domestic spying debacle, I wouldn't think that only debtors in bankruptcy need to worry about their phones being tapped. I'm sure that the federal government will tap anyone for any reason whatsoever. As for whether they can use that information...well, it's more likely that the agents listening to the tapes will get thrills from what they hear than that they actually find information about terrorist plots / hidden assets in bankruptcy / whatever.

              I wasn't trying to be flip, just a little humor. My wife and I went through hell with depos, etc... We came out ok in the end. Always remember there is an end to the nightmare. Your mind is NOT stretching any further than mine did. It is not abnormal to have these questions and fears if you are going through the Trustee, his Attorney or in front of the Judge.

                The so called domestic spying is a farce. No one gives a rat ass about you, your mails, your phone calls, or your life, unless they have evidence that you are connected to terrorism. The notion that somehow the government is interested in what Joe Six Pack does in his daily life, is absolute nonsense. The government surveyance is taxed to the limit as it is, tailing known and suspected terrorists, those with solid lead. There is simply not enough resources to spy on your grandma making phone calls. The notion is simply absurd.

                There are ways to search for properties, bank accounts, shell corporations, brokerage accounts etc. These are routinely used by judgement collectors and private investigators.

                Tapping filer's phone is nonsense, unless you are a major fish with known assets in the millions and are thus being heavily investigated for fraud.

                  It is a total farce.

                  You would not believe the steps the FBI has to go through to get a "legal" wire tap on a phone. I doubt a trustee would even have standing to even seek one.
