I want to see a bk attorney last week and he said there was no way that we could file a chapter 7 since our income is too high and all of our debt is cash advance debt. I asked him if my husband could be held responsible for my debt and he said that it depends if my husband is a co-signer on the account, that would make him equally liable even if he had never used the account. How do I find out which accounts my husband is a co-signer on? If we are not behind on any debt (secure) such as our cars and our home will we be required to do more than 36 months on a plan? I have refinanced our house three times in the last three years and have maxed out all of our credit card cash advances to where we owe close to $150,000. I know I am to blame and I am getting help for my gambling addiction but why do credit card companies allow you to repeatedly get cash advance to pay a casino? And the cash advance checks are all made out to the casino so they should know they are being used for gambling. And to top it all off, Bank One said that we now have too much credit card debt so even though we have never missed one payment and always paif more than the minimum balance, they raised our interest rate from 6% to 30%. That sure will help us keep paying!!!

The only way to be really sure about whether he is on the cards as a co-signer would be to call the individual card companies and ask. As for the question on how they can keep lending you money even to gamble: it's easy, they just don't care. You can use convenience checks and write in the memo section that it is for the purchase of crack cocaine for your 3 year old and they wouldn't care. They are in the business of making money.
