    Credit Report

    Filed Bankruptcy Chapter 7. It was discharged over a year ago. Our mortgage
    was included in our bankruptcy. We let the house go into foreclosure.
    My question is this, on my credit report, the former mortgage company lists
    our bankruptcy filing date many months after we filed. Is there some reason
    they benefit from this? Or could it just be an "innocent" mistake?

    Are you sure the date they are listing is not your discharge or closure date?

      No. It isn't even the closing date. It is a couple months after that even.

        We have the same problem, CS. Different Creditors reporting different dates of our BK. And none of the dates are the day we filed or our Discharge.

        It's like they took a dart board calendar, threw a dart and said, "Yep! That date looks good! Let's report that!"

        And every time we dispute asking to have the information verified, the date changes. On our Credit Reports, the date shown for the BK to drop off keeps getting pushed further and further out with each attempt to correct the reporting.

        Another problem we're having is Charge Offs. Even tho none of our accts were Charged Off at the time we filed BK, several Creditors are reporting that way. Or we have a combo reporting. "Charged Off" or "Bad Debt" AND IIB. It's my understanding that "Charged Off" and "Bad Debt" are not the proper reporting for debts Included in BK.

          I am having the same problem. I pulled my report last night. Frankly, I have been scared to see it! Anyway, it shows Chase and BOA as charged off. Also mortgage shows lates even though it was included in BK (yes it is late, and the house is going in a month or two, if not sooner). However, I did not think they would continue to report as such.

            I am in the same boat

            Hi

            Its been awhile since I have posted on the boards. I have been trying to clean my credit report for months after my discharge in July 06. I decided to keep my car through the Ch7 BK and I signed a reaffirmation agreement with the bank for my car and went to a separate court appearance so that the judge could ask if I knew what I was doing because I filed Pro-se.

            Anyway I kept up my payments on this car. I will admit that I missed 1 payment due to lack of funds last summer, so July's payment was paid in August and August payment in September and so forth. So my CR had a 30 day late because of this. Well I paid in full on Feb 1 2007 - the same month my car loan was to end after 5 1/2 years.

            To my dismay my CR's are saying that this acct was included in Ch 7 BK. One CR states acct closed/paid 2/2007 but in BK. Now I filed BK on 04/06.
            Another CR doesn't list any activity since Dec 2005 - way before my BK filing and no where near the late payment in July 06.

            I have disputed with the CR's and they come back statng that the bank verified this info.

            How can this be included in bk, if I signed a reaffirmation agreement with the bank and paid in full?

            Should I fight with the bank? That's what the CR's say to complain to them because they are supplying the info.

            Should I just attach the 100 word statement on the CR?

              It's my understanding, your first attempt at correction is with the Credit Reporting Bureaus. After they verify and correct or don't, then the next step is to approach the Lender/Creditor directly. If the Creditors don't report accurately, they violate Fair Credit practices.

              Someone will correct me if that's wrong.

                I would do is attach a copy of all creditors listed in BK and forward to the credit bureau's and to the Bank that is reporting it along with a letter that ask them to remove the bk from that within 30 days. The CB should do it with that copy of creditors because you are proving that bank was not listed or that debt in BK also I would attach a paid in full copy so they see and send this to all three CB's
