    Car repairs on AMEX?

I'll be needing to put some car repairs on my AMEX card, the repairs are going to be close to $1500. Otherwise, it is not safe to drive.

Will this be flagged as a "luxury" or high dollar expense?

    Thanks!

Have you already filed or are you planning to very soon? Depending on that answer if you have it fall under the 70/90 rule it won't be flagged as either, just AMEX might object to that particular charge getting dishcarged, so you may have to pay that $1500 back. However sometimes they don't object unless it's a fair amount they are objecting to.

At $1500, in the 70/90 day time frame, you're kinda in a grey area as to whether they'll Object or not.

In order to Object, they're gonna have to recover enough money to make it worth their while. They've gotta pay their legal expenses too.

They'll look at what you purchased. If it was airplane tickets or a fur coat, they might. Car repairs fall into the necessity category. They might not.

No way to really tell you. But if they do Object, you'd only be responsible to pay back that one debt. Generally speaking, Creditors will set up a payment plan with you. Your attny could negotiate that.

I haven't filed yet. I probably won't until October, maybe later.

I just learned though that the mechanic doesn't accept AMEX, but I have some of the "convienience checks". Can I use those or are they considered a cash advance?

        Thanks again!

They will be considered a cash advance -- and therefore fall under the 70 day rule.

Go ahead and use it, and keep your receipt to prove it was not for "luxury goods"

The presumption of fraud applies to cash advances regardless of what the cash advance was used for. (Only for purchases does the presumption apply only to "luxury goods and services"). So if they sue to determine dischargeability of that debt, *you* have to prove that it wasn't fraudulently incurred.
