    Filing Chapter 7 by myself

    Hello,

    my first post here.

    I plan to do it by myself in the state of Virginia.

    Could somebody please give me the list of forms I am supposed to fill out.

    I have seen the forms but not sure which ones I should fill and which ones I do not need to for a no asset, chapter 7 case.

    Well if you want to file on your own I would strongly recommend using a Bankruptcy book.

    I bought Law Made Simple: The New 2005 Bankruptcy ACT Personal Bankruptcy Simplified by Daniel Sitarz. It came with a CD with all the nationally recognized forms.

    I have since decided to use a lawyer, after reading this forums and studying the issue more. The book though above is well written and walks you through it. Just keep in mind if you make a mistake they can dismiss the case and you can't refile for 6 months and may not be able to list certain debts after the first dismissal.

    You can go to the U.S. Bankruptcy Court website as well and download forms from there but there are no instructions. You'll also need to check with the Clerk of the Court for your district and see what local forms are required.

    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      Another resource that many Pro Se filers has used is the Nolo Bankruptcy Book.

      Whether you decide to use an attny or not, I'd strongly suggest you Consult with 3-4 anyway. Consults are generally free and you can learn a lot.

      You can research some first. Then when you meet with attnys, ask any questions you may have that come up during your research. Also chatting with attnys, you can learn little things about your Court. What's allowed and what's not in the way of Expenses. Things like that.

      Another thing you can do is sign up on PACER. Look at recent filings in your area. See how attnys are submitting Petitions. $/mo for food. Is Entertainment an accepted expense in your area. If so, how much/mo. That kind of thing.
