    No sure if anyone can help but here goes...

    I filed Chapter 7 in 2006. I was discharged and my case was closed as a no asset case. I had an LLC that I walked away from. I didn't declare bk on the business, just closed the door and let the bank take back the equipment. In 2005 I had an NOL from the business of about $45,000 that "passed through" to my personal taxes. My carry-over NOL in 2006 would be about $23000. I also had a capital gain loss carryover of $3,000.

    My question is do I continue to claim my NOL even though the business became insolvent in 2005?

    Does the Trustee file a tax return for every case including a no asset case?
    (If the Trustee does, I'm pretty sure they get the NOL and Capital Gain loss)

    Any help would be appreciated.

    On LLC tax pass through is the rule

    ...if partnership or sole ownership. So since all tax liability passed to you, NOL will continue to be passed through until is "used up" on your personal taxes over the next several years' filings.

    What would the trustee need to file taxes on??? No monies administered and it is not as if the IRS will be handing trustee any of the NOL $$$...

    You are doing what I had to do with my LLC NOL last year and this, so no worries.
