    2nd Mortgage

    Our 2nd Mortgage is reporting to all 3 credit bureaus that the loan was "included in bankruptcy" and showing a "0" balance. I have been, and will continue to keep, paying this as I do not want to lose my house.

    Just wondering if:

    a) since I did not reaffirm is there anyway for me to get this corrected? I have always paid this on time and would like to have that positive trade line on my CBRs.

    b) Does the lender actually see this as a discharged debt?

    Yep, the Lender does actually view the Loan as Discharged. Because it is.

    When you did not Reaffirm, that note became like all your other Unsecureds. Discharged debt.

    Even tho it is not being reported to the Credit Bureaus, there are alternate ways to prove you did indeed pay, as agreed, on time. Say you sell the house and go to buy another,............

    You could get year end Statements from this Lender that show all payments posted each year. Hang on to those Statements. Then there's the HUD1 Statement from Closing when you sell the house. That will show payment to the 2nd from the Seller's Funds Distribution. When you go to finance a new home, you can show your HUD1 and year end Statements as proof that you did, indeed, pay as agreed.
