    Considering BK

    Here is my story.....

    A year ago I went through a divorce. My income at work went down 40%. I took out a loan from my 401k for 25k to help me make ends meet until the salary came back up. Now it looks like it is not coming back and I'm about $1320 in the red on a monthly basis. I'm nearing the end of the rope. I have no other places to get money from so BK seems like my last option. I have read this forum and it has been a great help. I'm current on ALL my bills and have received my income tax refund that will keep me afloat for another 2 months. After that it's going to be impossible to make it. An advice, words of wisdom would be greatly appreciated.

    Anyone in S FL can recommend an attorney?

    Stop paying any CC and any unsecured debt RIGHT NOW. Save the money instead and use it to improve your living situation, yourself and stock up on non-perishable.

      Go to www.martindalehubbel.com and look for a lawyer there. Look for ones that are AV rated. Once you get the list for your area, you will see their ratings after you click on the atty's name. AV is the best rating an atty can get and IMO, it's worth it to have the best even if it means paying a little extra for it. I have stuff to lose and I want to keep whatever little I have left!

      An experienced BK atty will help you determine what your best options are. Good luck and ask any questions that you can - the people here are fabulous!
      11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!

        This is a really great site and you'll find lots of helpful info.

        My situation is very similiar to yours. Like Spartan says, stop paying the cc and you will most likely be able to 'live' and not go in anymore debt.

        My game plan is to stop paying on mine in June.

        A friend was telling me to go to the court house and attend a 341 meeting. There, you'll see which attorneys seem "good" and which are just passing time. You can always approach one of the good attorneys to get their business card.

          Only one word of caution ... in your divorce decree, were you named as responsbile party for any joint debt .. ie credit cards. If this is the case, those debts become non dischargeable.
