    Trustee Payments

    Is there any grace period regarding the payment date?

    If the payment is due the 1st of the month, do they have a problem with the check being cut and mailed on the 1st?

    I have the trustee draft the money out of my account on the 20th of the month. I am not sure how strict they are on when you send your payment in, but if you can set up an EFT then I would suggest it. It takes all the effort out of making your payment. I am 23 months into a 41 month plan.

      My attorney's office has always said as long as you aren't over 30 days late you are ok. I would think a check mailed on the 1st would be fine. I would send it express mail so that it gets there the next day.

        It really depends on how strict the Trustee is about getting payments. Some are VERY strict. Others are more lenient and allow for mailing time.

        It's really gonna depend on your particular Trustee what will happen.

          When I first began my chpt. 13, there was time missing on my paycheck, which meant my check was short. I contacted my attorney who made arrangements with the trustee for me to make two payments that month, (I get paid bi-weekly). My employer corrected the error and put my missing earnings on the next check and I was able to make the payment. I could've made the entire payment with the first check, but that would have left me literally with nothing until the next payday.

            My payment is due on the 26th of the month. The payment is taken out of DH's check the first Friday of every month. We set it up like that because it worked in our monthly budget. But our payment to the trustee is always made 3 weeks early. It is okay, though, I will do anything to stay under the trustee's radar. That's me, the poster child for Chapter 13, lol, lol.

              There was one month in year two where I realized that I had missed a payment. eep! But! I was still less than 30 days pastdue. I called my attorney and was told it was ok, but to get the payment in as soon as possible.

              There was a point in these last 4 years where my paychecks didn't come in until the 15th. Sometimes 16th or 17th. My payment is due the 19th. So, if you were to look at my payment history, you'd see all these payments of the 20th, 21st, or 22nd. Now. I have not heard anything about this AT ALL. So I am going by the "no news is good news" axiom in this deal. I have not missed a payment, and the one payment I thought I missed was only a couple of weeks late.

              We'll see when I actually finish.

                If it looks like you might have a problem should you contact the trustee and let him know, or should you contact your attorney?

                  Whew! I am relieved to see the posts above. I had not read this thread a few days ago when I posted my most recent thread inquiring about how many days can you be late on your trustee payment, before receiving a dismissal? In our case, we have only had two late payments in the past 12 months of Chap. 12 BK, between 3-6 days after the due date. I was also going by the "no news is good news" theory. If we are really o.k. as long as it's not 30 days past due, then I guess I really don't need to stress out and worry so much about being 3 days late recently. What a relief!
