Hi everyone, this is my first time posting but I have read quit a bit on here. My husband got ourselves into a financial difficulty & we are now having to file Chapter 13. We have alreay retained at attorny & today we dropped all of our paperwork to him & we have to go back on Thursday to signed everything & case to will be filed. My ? is: My husband only receives Social Security Disability & has been for about the last 4/5 years, therefore he doesn't file any tax returns & hasn't since being on disability but I do & have for the last 5 years will we still be able to file?

The Court just needs to know you have a reliable income to fund Plan payments. Since you do, then you can file a Ch 13.

Are you filing Ch 13 due to income level being over the Median, or,......... Are you behind on an asset that you wanna keep? House? Car? Or too much equity to protect with Exemptions?Filed Ch 7 - 09/06
