I need some advice or guidance regarding a Chap 13 house refinance. I was able to work a refinance deal that will pay off the Chap 13. ( we are in NY, almost 2.5 years into a five year plan) Now here we are in the final stages and the law firm handling the arrears for the mortgage company sends me a notice of termination of stay. I have a payoff amount and a date (finally) it is good until. Let me add that this law firm is notoriously hard to deal with, you know, doesn't return calls, the person you spoke with yesterday isn't there or not on the directory, on hold for literally 10 minutes etc. They gave one payoff figure with a past date(!) then finally got off their duff and gave us a new one with a future date, then they send the summons for termination of stay dated the same day. My lawyer writes me a nasty note saying if I want to keep my home to contact him. I did so immediately, but got his answering machine and no return call that day or next. I called the law firm handling the arrears, did finally get hold of someone. She actually was rather nice, but said she can only talk to my attorney. So today, I wrote to the lawyer to have something in writing that I am trying to get this resolved. He should get it tomorrow. How long should I wait to contact the law firm for the arrears again? The date on summons is May 5th.
